Groups call on Michelle Bachelet for heightened UN scrutiny of human rights violations in Bahrain

Your Excellency,

We, the undersigned organisations, write to you to express our concern regarding the worsening situation for civil society in Bahrain. We believe co-ordinated international action coupled with public scrutiny are imperative to address the government of Bahrain’s ongoing attacks on civil society and to hold the kingdom accountable to its commitments to international human rights laws and standards. To this end, we call upon your Office to continue to monitor the situation in Bahrain and to continue to raise concerns at the highest level, both publicly and privately, with the government, as was done by your predecessor, Zeid Ra’ad Al Hussein. We believe heightened scrutiny of Bahrain’s human rights record and its ongoing human rights violations is particularly important now that the kingdom is a Member State of the Human Rights Council.

In the past two years, the Bahraini government increased its repression of the kingdom’s remaining civil society organisations, political opposition groups, and human rights defenders. In June 2016, Bahrain’s Administrative Court forcibly dissolved al-Wefaq, Bahrain’s largest political opposition society, a ruling that was upheld in February 2018. In May 2017, a court approved the forcible dissolution of the National Democratic Action Society, also known as Wa’ad. Only a month later, the government indefinitely suspended the kingdom’s last remaining independent newspaper, Al-Wasat, continuing its repression of free expression and press freedom.

While there were hopes that the government might ease repression in the run-up to elections for the lower house of parliament on 24 November 2018, these were dashed with a series of actions and policies that effectively precluded the elections from being free or fair, and that continued the broader assault on civil society. Only weeks ahead of ahead of the elections, the country’s highest appeals court sentenced Sheikh Ali Salman, the Secretary-General of Al-Wefaq, to life in prison on spurious charges of espionage dating from 2011. The government also enacted new legislation banning all individuals who had ever belonged to a dissolved political society from seeking or holding elected office, as well as anyone who has ever served six months or more in prison. This affects a large portion of Bahrain’s population, as the kingdom currently has around 4,000 political prisoners.

Beyond rigging the election process at the expense of political opposition societies and free and fair participation, over this past year Bahrain has continued to target, harass, and imprison activists and human rights defenders for exercising their right to free expression. The government criminalised calls to boycott the elections, and, on 13 November 2018, arrested former Member of Parliament Ali Rasheed al-Asheeri for tweeting about boycotting the November elections. On 31 December 2018, Bahrain’s Court of Cassation – its court of last resort – upheld prominent human rights defender Nabeel Rajab’s five-year prison sentence on spurious charges of tweeting and re-tweeting criticism of torture in Jau Prison and the war in Yemen, drawing criticism from the Office of the High Commissioner for Human Rights. With this decision, Rajab has exhausted all legal remedies to reverse the charges and will remain in prison until 2023. He has already served a two-year prison sentence on charges related to television interviews in which he discussed the human rights situation in the kingdom.

While Bahrain has several institutions tasked with oversight responsibilities and enforcing accountability for human rights abuses, we have grave concerns over their effectiveness, their independence, and their commitment to fulfilling their mandates. Similar concerns have been raised about other Bahraini institutions – the National Institution for Human Rights (NIHR) and the Ministry of Interior Ombudsman – by the UN Human Rights Committee. In the Committee’s first evaluation of Bahrain under the International Covenant on Civil and Political Rights (ICCPR) in July 2018, it found the NIHR largely lacked sufficient independence from the government. The European Parliament has also criticised the NIHR, including in a June 2018 resolution where the body expressed “regret” for the honours it has bestowed upon the NIHR. In the resolution, the European Parliament cited the institution’s lack of independence to fulfil its duties. The Ministry of Interior (MoI) Ombudsman has received sharp criticism, including from the UN Committee Against Torture (CAT). The CAT cited the Ombudsman’s lack of independence, impartiality, and efficacy in addressing complaints submitted to the institution.

Bahrain’s national institutions not only fail to implement human rights reforms, they help perpetuate and whitewash abuses. Both the Ombudsman and NIHR have released reports that sanitise violations like police brutality, while neglecting to address or condemn violent police raids on peaceful protests.

The failure of Bahrain’s human rights institutions to address serious abuses both reflects and promotes a broader culture of impunity in the country, where the government can continue to suppress free expression and civil society.

Despite these abuses and despite concerns from UN bodies, Bahrain has not been the subject of collective action in the United Nations Human Rights Council (HRC) since a joint statement in September 2015 at HRC 30. Since then, the government has taken increased steps to limit fundamental freedoms, including restricting the rights to free expression, free assembly, free association, and free press, dissolving political opposition societies and jailing human rights defenders, religious leaders, and political figures. However, even as Bahrain has embarked on this campaign to suppress opposition and dissent, state action on Bahrain in the HRC has been limited to individual condemnations by various governments under Agenda Items 2 and 4.

Despite this lack of joint action, the Office of the High Commissioner has been consistently vocal about Bahrain’s rights abuses, and we are very appreciative of the Office’s attention over the past several years. Your predecessor raised concerns about Bahrain in his opening statements at the HRC, including at the 36th Council session, where he highlighted restrictions on civil society and the kingdom’s lack of engagement with international human rights mechanisms, and at 38th Council session, in which he reiterated past concerns and sharply criticised Bahrain for its continued refusal to co-operate with the Office of the High Commissioner and the mandates of the Special Procedures.

We believe that this UN scrutiny is now even more necessary as Bahrain assumes a seat on the Council as a Member State.

We strongly urge you to continue to monitor the situation, to publicly express your concerns to Bahraini officials, and to call on the Bahraini government to meet its international obligations, including those concerning protecting and promoting civil society. Without an independent, viable civil society in the country there can be no serious domestic pressure on the government to relax restrictions and ease repression.

We call on you to highlight Bahrain’s restrictions on civil society, targeting of human rights defenders, dissolution of political opposition, and unrelenting attacks on free expression in your opening statement at the 40th Human Rights Council session, the first session of which Bahrain is a member of the Council.

NetBlocks tool tracks cost of internet shutdowns

NetBlocks, which grew out of the 2017 Freedom of Expression Digital Activism Award-winning Turkey Blocks, is a nonprofit organisation created in 2016 to harness technology to map internet freedom. The civil society group aims to protect and support digital rights, cyber-security and internet governance.

“The goal is to go beyond research into prototyping, implementation and deployment of completely new mechanisms that might be able in future to protect and extend our fundamental rights,” Toker said.

NetBlocks has partnered with the Internet Society to create a new tool, Cost of Shutdown Tool (COST), that will cover social media and key content platforms, as well as full internet blackouts.

“What’s the cost of censorship? How much do internet shutdowns cost ordinary citizens? These are the questions we set out to answer at NetBlocks with COST, because traditional advocacy around freedom of expression doesn’t always make the impact it should, but financial figures make authorities listen,” Toker said.

The COST tool has been in a beta mode throughout 2018. NetBlocks estimated a loss of £23.7 million from the March 2018 Sri Lankan internet shutdowns that took place in response to violent riots.

COST’s main goal is to spread awareness about the true costs and effects of online shutdowns. The NetBlocks teams hopes that this will prompt citizens to put pressure on the authoritarian governments who are most responsible for online censorship.

Gillian Trudeau from Index on Censorship spoke to Alp Toker about NetBlock’s new tool, COST, and what to expect from it.

Index: What is the Cost of Shutdown Tool (COST) and what does it do?

Toker: What’s the cost of censorship? How much do internet shutdowns cost ordinary citizens? These are the questions we set out to answer at NetBlocks with COST, because traditional advocacy around freedom of expression doesn’t always make the impact it should, but financial figures make authorities listen.

The Cost of Shutdown Tool (COST) is a data-driven online tool to quickly and easily estimate the economic cost of internet disruptions. Built around economic methodologies devised by the Brookings Institution and CIPESA, the Cost of Shutdown Tool (COST) estimates economic cost of internet shutdowns, mobile data blackouts and social media restrictions using regional indicators from the World Bank, ITU, Eurostat and U.S. Census. The tool will cover shutdowns affecting social media, key content platforms and full Internet blackouts using key indicators relating to the global digital economy. COST is officially launching Monday 10 December, 2018.

Index: What do you hope to achieve with the project?

Toker: We hope to enable anyone – including journalists, researchers, advocates, policy makers, businesses — to understand how much internet disruptions can cost economies, as well as support advocacy and policy work to end online mass-censorship.

Index: How did your relationship with the Internet Society start and what do they bring to the project?

Toker: The Internet Society (ISOC) is a global organisation with over one hundred chapters around the world dedicated to ensuring that the internet stays free and open. We connected at the Internet Engineering Task Force where we are working to strengthen internet protocols for human rights, and things immediately clicked. The partnership has been very strong because it is built around both impact around human rights and technological development — areas of expertise for both organisations. With the Internet Society’s global access, we’ve been able to explore new ways to identify and push back against internet disruptions that harm human rights around the world.

Index: Why should we be concerned about internet shutdowns?

Toker: Internet shutdowns are increasingly used by governments to control the flow of information, particularly around elections or political unrest. Internet shutdowns create chaos through all facets life, from accessing medical services to getting in contact with family members.

Through our work in the #KeepItOn campaign, we’re continuing to monitor these shutdowns around the world. Open access to internet is a key part of a functioning democracy, and is protected by international law and conventions.

Index: What cost estimates do you have for internet shutdowns in 2018?

Toker: In it’s beta mode, the tool has already been used to bolster advocacy efforts around the world. Our first experience using the tool in advocacy came when Sri Lanka shut down parts of the internet during protests, leading to an estimated loss of $30,000,000 USD. Because we were able to calculate the number instantly, it became the basis of a national campaign launched by Sri Lanka’s Social Media User’s Union. In Iraq, multi-day outages cost the economy an estimated $40,000,000 USD. Again, this figure was picked up widely by local and international media and caught the attention of everyone from street vendors to the oil industry. Another shutdown in Ethiopia had a more modest impact of 3,500,000 birr, but that impact targeted a small region with a developing economy and its impact was felt hard. Working with the #KeepItOn coalition, we wrote to the Ethiopian government to highlight the concern with their policy.

Index: What trends in internet shutdowns can we expect COST to uncover in 2019?

Toker: There is a growing tendency toward mass-censorship online, particularly in developing countries. We’ve been seeing more localised disruptions, and COST is now able to estimate the impact of sub-national shutdowns — a powerful approach that highlights the economic impact to a local community.

We have also seen more precisely timed shutdowns, intended to evade detection and reporting. For these reasons, COST works best when there is hard technical evidence of an internet disruption. Hence, it works great in tandem with real-time monitoring data from the NetBlocks internet observatory, which uses new techniques to accurately track such incidents.

In addition, research shows little evidence that cutting off communications provides relief in these situations, but it has been shown again and again that shutdowns do impact emergency first-response, healthcare and the provision of critical service. This is in addition to their severe impact on the fundamental rights of free expression, free assembly and free association.

Index: What are the worst and best countries for internet freedom and why?

Toker: Pakistan and India face systematic disruptions at massive scale, and the problem is also endemic in sub-Saharan Africa. There are also frequent disruptions in the Middle East, and a new trend emerging of shutdowns in Central America.

Index: When was the NetBlocks group created?

Toker: The idea for NetBlocks came about in 2015 and was recognisable in its current form by 2016. We entered the spotlight in 2017 after the first two modules of the internet observatory was launched. Meanwhile, The Index on Censorship Award helped us focus at a critical moment in time with a backdrop of contested elections, overbearing corporations, and the breakdown of online trust. In a time of rapid change the fellowship gave us a way to channel creative energy into a force for good.

Index: Why was the NetBlocks group created?

Toker: NetBlocks exists to meet the overwhelming need and demand for rights-based technology in support of free expression and access to knowledge. The goal is to go beyond research into prototyping, implementation and deployment of completely new mechanisms that might be able in future to protect and extend our fundamental rights. Internet-scale measurement, data-driven policy and advocacy, rights-based internet protocol design, machine learning to uncover violations of fundamental rights: these are some of the new frontiers. I’m sure there will be more.

There are competent civil society technology programmes out there today, but why not shake things up and put the tech at the forefront of the mission? Journalism, writing, the creative arts now exist largely in digital spaces, more vulnerable than at any time in our history. Saudi Arabia: Kingdom must be held to account for suppression of dissent

Recognising the fundamental right to express our views, free from repression, we the undersigned civil society organisations call on the international community, including the United Nations, multilateral and regional institutions as well as democratic governments committed to the freedom of expression, to take immediate steps to hold Saudi Arabia accountable for grave human rights violations. The murder of Saudi journalist Jamal Ahmad Khashoggi in the Saudi Consulate in Istanbul on 2 October is only one of many gross and systematic violations committed by the Saudi authorities inside and outside the country. As the International Day to End Impunity for Crimes against Journalists approaches on 2 November, we strongly echo calls for an independent investigation into Khashoggi’s murder, in order to hold those responsible to account.

This case, coupled with the rampant arrests of human rights defenders, including journalists, scholars and women’s rights activists; internal repression; the potential imposition of the death penalty on demonstrators; and the findings of the UN Group of Eminent Experts report which concluded that the Coalition, led by Saudi Arabia, have committed acts that may amount to international crimes in Yemen, all demonstrate Saudi Arabia’s record of gross and systematic human rights violations. Therefore, our organisations further urge the UN General Assembly to suspend Saudi Arabia from the UN Human Rights Council (HRC), in accordance with operative paragraph 8 of the General Assembly resolution 60/251.

Saudi Arabia has never had a reputation for tolerance and respect for human rights, but there were hopes that as Crown Prince Mohammed Bin Salman rolled out his economic plan (Vision 2030), and finally allowed women to drive, there would be a loosening of restrictions on women’s rights, and freedom of expression and assembly. However, prior to the driving ban being lifted in June, women human rights defenders received phone calls warning them to remain silent. The Saudi authorities then arrested dozens of women’s rights defenders (both female and male) who had been campaigning against the driving ban. The Saudi authorities’ crackdown against all forms of dissent has continued to this day.

Khashoggi criticised the arrests of human rights defenders and the reform plans of the Crown Prince, and was living in self-imposed exile in the US. On 2 October 2018, Khashoggi went to the Consulate in Istanbul with his fiancée to complete some paperwork, but never came out. Turkish officials soon claimed there was evidence that he was murdered in the Consulate, but Saudi officials did not admit he had been murdered until more than two weeks later.

It was not until two days later, on 20 October, that the Saudi public prosecution’s investigation released findings confirming that Khashoggi was deceased. Their reports suggested that he died after a “fist fight” in the Consulate, and that 18 Saudi nationals have been detained. King Salman also issued royal decrees terminating the jobs of high-level officials, including Saud Al-Qahtani, an advisor to the royal court, and Ahmed Assiri, deputy head of the General Intelligence Presidency. The public prosecution continues its investigation, but the body has not been found.

Given the contradictory reports from Saudi authorities, it is essential that an independent international investigation is undertaken.

On 18 October, the Committee to Protect Journalists (CPJ), Human Rights Watch, Amnesty International, and Reporters Without Borders (RSF) called on Turkey to request that UN Secretary-General Antonio Guterres establish a UN investigation into the extrajudicial execution of Khashoggi.

On 15 October 2018, David Kaye, the UN Special Rapporteur on freedom of expression, and Dr. Agnès Callamard, the UN Special Rapporteur on summary executions, called for “an independent investigation that could produce credible findings and provide the basis for clear punitive actions, including the possible expulsion of diplomatic personnel, removal from UN bodies (such as the Human Rights Council), travel bans, economic consequences, reparations and the possibility of trials in third states.”

We note that on 27 September, Saudi Arabia joined consensus at the UN HRC as it adopted a new resolution on the safety of journalists (A/HRC/Res/39/6). We note the calls in this resolution for “impartial, thorough, independent and effective investigations into all alleged violence, threats and attacks against journalists and media workers falling within their jurisdiction, to bring perpetrators, including those who command, conspire to commit, aid and abet or cover up such crimes to justice.” It also “[u]rges the immediate and unconditional release of journalists and media workers who have been arbitrarily arrested or arbitrarily detained.”

Khashoggi had contributed to the Washington Post and Al-Watan newspaper, and was editor-in-chief of the short-lived Al-Arab News Channel in 2015. He left Saudi Arabia in 2017 as arrests of journalists, writers, human rights defenders and activists began to escalate. In his last column published in the Washington Post, he criticised the sentencing of journalist Saleh Al-Shehi to five years in prison in February 2018. Al-Shehi is one of more than 15 journalists and bloggers who have been arrested in Saudi Arabia since September 2017, bringing the total of those in prison to 29, according to RSF, while up to 100 human rights defenders and possibly thousands of activists are also in detention according to the Gulf Centre for Human Rights (GCHR) and Saudi partners including ALQST. Many of those detained in the past year had publicly criticised reform plans related to Vision 2030, noting that women would not achieve economic equality merely by driving.

Another recent target of the crackdown on dissent is prominent economist Essam Al-Zamel, an entrepreneur known for his writing about the need for economic reform. On 1 October 2018, the Specialised Criminal Court (SCC) held a secret session during which the Public Prosecution charged Al-Zamel with violating the Anti Cyber Crime Law by “mobilising his followers on social media.” Al-Zamel criticised Vision 2030 on social media, where he had one million followers. Al-Zamel was arrested on 12 September 2017 at the same time as many other rights defenders and reformists.

The current unprecedented targeting of women human rights defenders started in January 2018 with the arrest of Noha Al-Balawi due to her online activism in support of social media campaigns for women’s rights such as (#Right2Drive) or against the male guardianship system (#IAmMyOwnGuardian). Even before that, on 10 November 2017, the SCC in Riyadh sentenced Naimah Al-Matrod to six years in jail for her online activism.

The wave of arrests continued after the March session of the HRC and the UN Committee on the Elimination of Discrimination against Women (CEDAW) published its recommendations on Saudi Arabia. Loujain Al-Hathloul, was abducted in the Emirates and brought to Saudi Arabia against her will on 15 May 2018; followed by the arrest of Dr. Eman Al-Nafjan, founder and author of the Saudiwoman’s Weblog, who had previously protested the driving ban; and Aziza Al-Yousef, a prominent campaigner for women’s rights.

Four other women’s human rights defenders who were arrested in May 2018 include Dr. Aisha Al-Manae, Dr. Hessa Al-Sheikh and Dr. Madeha Al-Ajroush, who took part in the first women’s protest movement demanding the right to drive in 1990; and Walaa Al-Shubbar, a young activist well-known for her campaigning against the male guardianship system. They are all academics and professionals who supported women’s rights and provided assistance to survivors of gender-based violence. While they have since been released, all four women are believed to be still facing charges.

On 6 June 2018, journalist, editor, TV producer and woman human rights defender Nouf Abdulaziz was arrested after a raid on her home. Following her arrest, Mayya Al-Zahrani published a letter from Abdulaziz, and was then arrested herself on 9 June 2018, for publishing the letter.

On 27 June 2018, Hatoon Al-Fassi, a renowned scholar, and associate professor of women’s history at King Saud University, was arrested. She has long been advocating for the right of women to participate in municipal elections and to drive, and was one of the first women to drive the day the ban was lifted on 24 June 2018.

Twice in June, UN special procedures called for the release of women’s rights defenders. On 27 June 2018, nine independent UN experts stated, “In stark contrast with this celebrated moment of liberation for Saudi women, women’s human rights defenders have been arrested and detained on a wide scale across the country, which is truly worrying and perhaps a better indication of the Government’s approach to women’s human rights.” They emphasised that women human rights defenders “face compounded stigma, not only because of their work as human rights defenders, but also because of discrimination on gender grounds.”

Nevertheless, the arrests of women human rights defenders continued with Samar Badawi and Nassima Al-Sadah on 30 July 2018. They are being held in solitary confinement in a prison that is controlled by the Presidency of State Security, an apparatus established by order of King Salman on 20 July 2017. Badawi’s brother Raif Badawi is currently serving a 10-year prison sentence for his online advocacy, and her former husband Waleed Abu Al-Khair, is serving a 15-year sentence. Abu Al-Khair, Abdullah Al-Hamid, and Mohammad Fahad Al-Qahtani (the latter two are founding members of the Saudi Civil and Political Rights Association – ACPRA) were jointly awarded the Right Livelihood Award in September 2018. Yet all of them remain behind bars.

Relatives of other human rights defenders have also been arrested. Amal Al-Harbi, the wife of prominent activist Fowzan Al-Harbi, was arrested by State Security on 30 July 2018 while on the seaside with her children in Jeddah. Her husband is another jailed member of ACPRA. Alarmingly, in October 2018, travel bans were imposed against the families of several women’s rights defenders, such as Aziza Al-Yousef, Loujain Al-Hathloul and Eman Al-Nafjan.

In another alarming development, at a trial before the SCC on 6 August 2018, the Public Prosecutor called for the death penalty for Israa Al-Ghomgam who was arrested with her husband Mousa Al-Hashim on 6 December 2015 after they participated in peaceful protests in Al-Qatif. Al-Ghomgam was charged under Article 6 of the Cybercrime Act of 2007 in connection with social media activity, as well as other charges related to the protests. If sentenced to death, she would be the first woman facing the death penalty on charges related to her activism. The next hearing is scheduled for 28 October 2018.

The SCC, which was set up to try terrorism cases in 2008, has mostly been used to prosecute human rights defenders and critics of the government in order to keep a tight rein on civil society.

On 12 October 2018, UN experts again called for the release of all detained women human rights defenders in Saudi Arabia. They expressed particular concern about Al-Ghomgam’s trial before the SCC, saying, “Measures aimed at countering terrorism should never be used to suppress or curtail human rights work.” It is clear that the Saudi authorities have not acted on the concerns raised by the special procedures – this non-cooperation further brings their membership on the HRC into disrepute.

Many of the human rights defenders arrested this year have been held in incommunicado detention with no access to families or lawyers. Some of them have been labelled traitors and subjected to smear campaigns in the state media, escalating the possibility they will be sentenced to lengthy prison terms. Rather than guaranteeing a safe and enabling environment for human rights defenders at a time of planned economic reform, the Saudi authorities have chosen to escalate their repression against any dissenting voices.

Our organisations reiterate our calls to the international community to hold Saudi Arabia accountable and not allow impunity for human rights violations to prevail.

We call on the international community, and in particular the UN, to:

  1. Take action to ensure there is an international, impartial, prompt, thorough, independent and effective investigation into the murder of journalist Jamal Ahmad Khashoggi;
  2. Ensure Saudi Arabia be held accountable for the murder of Khashoggi and for its systematic violations of human rights;
  3. Call a Special Session of the Human Rights Council on the recent wave of arrests and attacks against journalists, human rights defenders and other dissenting voices in Saudi Arabia;
  4. Take action at the UN General Assembly to suspend Saudi Arabia’s membership of the Human Rights Council; and
  5. Urge the government of Saudi Arabia to implement the below recommendations.

We call on the authorities in Saudi Arabia to:

  1. Produce the body of Jamal Ahmad Khashoggi and invite independent international experts to oversee investigations into his murder; cooperate with all UN mechanisms; and ensure that those responsible for his death, including those who hold command responsibility, are brought to justice;
  2. Immediately quash the convictions of all human rights defenders, including women and men advocating for gender equality, and drop all charges against them;
  3. Immediately and unconditionally release all human rights defenders, writers, journalists and prisoners of conscience in Saudi Arabia whose detention is a result of their peaceful and legitimate work in the promotion and protection of human rights including women’s rights;
  4. Institute a moratorium on the death penalty; including as punishment for crimes related to the exercise of rights to freedom of opinion and expression, and peaceful assembly;
  5. Guarantee in all circumstances that all human rights defenders and journalists in Saudi Arabia are able to carry out their legitimate human rights activities and public interest reporting without fear of reprisal;
  6. Immediately implement the recommendations made by the UN Group of Eminent Experts on Yemen; and
  7. Ratify the International Covenant on Civil and Political Rights, and bring all national laws limiting the rights to freedom of expression, peaceful assembly and association into compliance with international human rights standards.

Saudi Arabia must implement UPR recommendations protecting freedom of expression

[vc_row][vc_column][vc_column_text]Dear Mr./Ms. Foreign Minister,

We, the undersigned, are writing to you concerning Saudi Arabia’s upcoming 3rd Cycle Universal Periodic Review (UPR) in November 2018 and ahead of the 39th Session of the United Nations (UN) Human Rights Council (HRC 39) in September. The UN HRC and the kingdom’s UPR review are important opportunities to raise concerns about Saudi Arabia’s abysmal human rights record and to press for urgently needed reforms. We thus call upon your government to publicly engage with Saudi Arabia during the forthcoming HRC as well as the UPR in November, to call for the release of detained writers and activists, and to issue strong recommendations to end restrictions on the right to freedom of expression.

During Saudi Arabia’s 2nd UPR cycle in October 2013, the kingdom received nine recommendations pertaining to protecting and promoting the right to freedom of expression out of 225 total recommendations. Saudi Arabia fully accepted three of these freedom of expression-related recommendations and partially accepted the remaining one. Despite this commitment, the kingdom has failed to implement the recommendations, and we remain concerned over the continued criminalization of the right to freedom of expression and opinion as Saudi Arabia’s UPR approaches in November.

Fundamentally, the Saudi government does not recognize the right to freedom of expression and opinion. Rather, the kingdom’s de facto constitution – the Basic Law – grants authorities the power to “prevent whatever leads to disunity, sedition and division,” including peaceful criticism. It likewise proclaims that “mass and publishing media and all means of expression shall use decent language and adhere to State laws. Whatever leads to sedition and division, or undermines the security of the State or its public relations, or is injurious to the honor and rights of man, shall be prohibited.” Subsequent laws have enshrined further limitations on free speech, including the 2000 Press and Publications Law, the 2007 Anti-Cybercrime Law, the 2014 Law on Terrorism and Its Financing, the 2015 Law on Associations, and most recently, the November 2017 Penal Law for Crimes of Terrorism and Its Financing which explicitly criminalizes expression critical of the King and the Crown Prince.

This web of legislation empowers Saudi officials to arrest activists, journalists, writers, and bloggers who are accused of crimes related to religion, including blasphemy, atheism, and apostasy, as well as crimes filed under the counter-terror law related to speech critical of the royal family, government, or ruling structure.

Among those currently in prison for speech crimes related to religion and critical expression of the government are:

– Blogger Raif Badawi, arrested in June 2012 on atheism charges for his writings and sentenced to 10 years in prison and 1,000 lashes;
– Palestinian poet Ashraf Fayadh, arrested in January 2014 on charges of atheism and apostasy for his poetry and serving a sentence of eight years in prison and 800 lashes– reduced from an initial death sentence;
Saleh al-Shehi, a columnist for al-Watan, arrested on 8 February 2018 and sentenced to five years in prison after he discussed corruption and the royal court on television;
At least 15 other journalists, including Nadhir al-Majid, who was charged on 18 January 2017 with “slandering the ruler and breaking allegiance with him,” and Wajdi al-Ghazzawi, the owner of religious satellite broadcaster Al-Fajr Media Group, who was sentenced on 4 February 2014 to 12 years in prison after he criticized the government and accused it of corruption.

The Saudi government has also arrested several women activists over their speech, including a number of prominent women human rights defenders arrested on 15 May 2018. According to nine UN Special Rapporteurs, although many of the women had advocated for gender equality and the lifting the ban on women driving, “reports state they were accused of engaging in suspicious communications with foreign groups allegedly working to undermine national security, and of trespassing against the country’s religious and national foundations.” In a demonstration of the kingdom’s attempt to silence women and activists, reports recently emerged that the government was seeking the death penalty against activist Israa al-Ghomgham, who was arrested in 2015 for her role in organizing protests and for calling for the release of political prisoners and an end to anti-Shia discrimination.

Saudi Arabia’s suppression of free expression demonstrates the kingdom’s failure to implement its 2nd Cycle UPR recommendations. We therefore see both the UN HRC session in September and the kingdom’s UPR in November as important and significant opportunities to raise concerns not only about ongoing restrictions on the right to freedom of expression, but also the kingdom’s failure to abide by its commitments to reform. To that end, we call upon your government to publicly urge Saudi Arabia to lift restrictions on free expression, call for the release of activists, journalists, and writers, urge implementation of its 2nd Cycle UPR recommendations, and offer serious follow-up recommendations during the 3rd Cycle UPR in November.
