In conversation with Timothy Garton Ash: A blueprint for freer speech

free speechTimothy Garton Ash is no stranger to censorship. On the toilet wall of his Oxford home, there is a Polish censor’s verdict from early 1989 which cut a great chunk of text from an article of his on the bankruptcy of Soviet socialism.

Six months later socialism was indeed bankrupt, although the formative experiences of travelling behind the Iron Curtain in the late 1970s and throughout the 1980s — seeing friends such as Aleksandr Solzhenitsyn interrogated and locked up for what they published — never left him.

Now, in Free Speech: Ten Principles for a Connected World, the professor of European Studies at Oxford University provides an argument for “why we need more and better free speech” and a blueprint for how we should go about it.

“The future of free speech is a decisive question for how we live together in a mixed up world where conventionally — because of mass migration and the internet — we are all becoming neighbours,” Garton Ash explains to Index on Censorship. “The book reflects a lot of the debates we’ve already been having on the Free Speech Debate website [the precursor to the book] as well as physically in places like India China, Egypt, Burma, Thailand, where I’ve personally gone to take forward these debates.”

Garton Ash began writing the book 10 years ago, shortly after the murder of Theo van Gough and the publication of the Jyllands-Posten Muhammad cartoons. In the second of the 10 principles of free speech — ranked in order of importance — he writes: “We neither make threats of violence nor accept violent intimidation.” What he calls the “assassin’s veto” — violence or the threat of violence as a response to expression — is, he tells Index, “one of the greatest threats to free speech in our time because it undoubtedly has a very wide chilling effect”.

While the veto may bring to mind the January 2015 killings at Charlie Hebdo, Garton Ash is quick to point out that “while a lot of these threats do come from violent Islamists, they also come from the Italian mafia, Hindu nationalists in India and many other groups”.

Europe, in particular, has “had far too much yielding, or often pre-emptively, to the threat of violence and intimidation”, explains Garton Ash, including the 2014 shutting down of Exhibit B, an art exhibition which featured black performers in chains, after protesters deemed it racist. “My view is that this is extremely worrying and we really have to hold the line,” he adds.

Similarly, in the sixth principle from the book — “one of the most controversial” — Garton Ash states: “We respect the believer but not necessarily the content of the belief.”

This principle makes the same point the philosopher Stephen Darwall made between “recognition respect” and “appraisal respect”. “Recognition respect is ‘I unconditionally respect your full dignity, equal human dignity and rights as an individual, as a believer including your right to hold that belief’,” explains Garton Ash. “But that doesn’t necessarily mean I have to give ‘appraisal respect’ to the content of your belief, which I may find to be, with some reason, incoherent nonsense.”

The best and many times only weapon we have against “incoherent nonsense” is knowledge (principle three: We allow no taboos against and seize every chance for the spread of knowledge). In Garton Ash’s view, there are two worrying developments in the field of knowledge in which taboos result in free speech being edged away.

“On the one hand, the government, with its extremely problematic counter-terror legislation, is trying to impose a prevent duty to disallow even non-violent extremism,” he says. “Non-violent extremists, in my view, include Karl Marx and Jesus Christ; some of the greatest thinkers in the history of mankind were non-violent extremists.”

“On the other hand, you have student-led demands of no platforming, safe spaces, trigger warnings and so on,” Garton Ash adds, referring to the rising trend on campuses of shutting down speech deemed offensive. “Universities should be places of maximum free speech because one of the core arguments for free speech is it helps you to seek out the truth.”

The title of the books mentions the “connected world”, or what is also referred to in the text as “cosmopolis”, a global space that is both geographic and virtual. In the ninth principle, “We defend the internet and other systems of communication against illegitimate encroachments by both public and private powers”, Garton Ash aims to protect free expression in this online realm.

“We’ve never been in a world like this before, where if something dreadful happens in Iceland it ends up causing harm in Singapore, or vice-versa,” he says. “With regards to the internet, you have to distinguish online governance from regulation and keep the basic architecture of the internet free, and that means — where possible — net neutrality.”

A book authored by a westerner in an “increasingly post-western” world clearly has its work cut out for it to convince people in non-western or partially-western countries, Garton Ash admits. “What we can’t do and shouldn’t do is what the West tended to do in the 1990s, and say ‘hey world, we’ve worked it out — we have all the answers’ and simply get out the kit of liberal democracy and free speech like something from Ikea,” he says. “If you go in there just preaching and lecturing, immediately the barriers go up and out comes postcolonial resistance.”

“But what we can do — and I try to do in the book — is to move forward a conversation about how it should be, and having looked at their own traditions, you will find people are quite keen to have the conversation because they’re trying to work it out themselves.”

Protests in motion: When films inspire rights’ movements

Films, like every kind of art, are often made purely for cinema’s sake – but sometimes they aren’t. Some of the most iconic recent films have actually played a major role in inspiring rights’ movements and protests around the world.

Ten Years, recipient of Hong Kong’s best film award on 3 April 2016, is just one of the latest examples of how cinema can side up with rights: films have often given protests momentum and a cultural reference.

Sometimes, directors have spoken out publicly in favour of protests; other times the films themselves have documented political abuses. In other cases, protesters and activists have given a film a new life, turning it into an icon for their protests on social media even against the directors’ original ideas.

Here are a few recent cases of popular films that have become symbols of rights’ movements around the world:

Ten Years

On 3 April, Ten Years was voted best film at the Hong Kong film awards, one of China’s most important film festivals – but most Chinese don’t know that, as the film is severely censored in mainland China.

Directed by Chow Kwun-Wai with a $64,500 budget, Ten Years is a “political horror” set in a dystopian 2025 Hong Kong. In the five short stories told in the film, Chow Kwun-Wai warns against the effects that ten years of Beijing’s influence would have on Hong Kong: The erosion of human rights, the destruction of local culture and heavy censorship.

According to the South China Morning Post, Ten Years was not intended to be a political film, but the political content is explosive to the extent that some critics have dubbed it “the occupy central of cinema”.

China Digital Times reports that both the film and the awards ceremony are banned in China. On Sina Weibo, China’s leading social network, the searches “Ten Years + Film Awards” (十年+金像) and “Ten Years + film” (十年+电影) are blocked from results.

Birdman

Winner of a 2015 Oscar, Birdman’s plot is not about rights or protests: The film told the story of a popular actor’s struggles years after his success impersonating a superhero.

But Mexican director’s Alejandro González Iñárritu’s acceptance speech turned it into the symbol of a protest against Mexican President Enrique Peña Nieto.

After asking for a respect and dignity for Mexican immigrants in the USA, Iñárritu said in his speech: “I want to dedicate this award for my fellow Mexicans, the ones who live in Mexico. I pray that we can find and build a government that we deserve.”

The speech came after the Mexican government declared the death of 43 students who went missing while organising a protest.

Iñárritu’s speech made Twitter erupt against Peña Nieto’s government under the hashtag #ElGobiernoQueMerecemos, “the government we deserve”.

Twitter user Guillermo Padilla said, “Now we are only missing a good ‘director’ in this country” – a play on words since “director” means both director and leader in Spanish.

In a photo, Birdman took the place of the Angel of Independence’s statue, symbol of Mexico City.

One user took it a step further, posting a “graphic description” of the effects of Iñárritu’s speech on the president.

Hunger Games

The sci-fi blockbuster Hunger Games took a life of its own in Thailand, where student demonstrators turned the protagonist’s salute into a symbol of rebellion against the ruling junta.

In the film, set in a heavily oppressed country where every year young people are forced to fight to death in a nationally televised contest, protagonist Katniss Everdeen defies the central government and inspires a rebellion against totalitarian rule. Her three-finger salute becomes the symbol of the protest.

In Thailand, students started to use the three-finger salute as a symbol of rebellion after the military government took power with a coup on 22 May 2014 and clamped down on all forms of protest, censored the country’s news media, limited the right to public assembly and arrested critics and opponents. According to The New York Times, hundreds of academics, journalists and activists have been detained for up to a month.

The Guardian reported that social activist Sombat Boonngam-anong wrote on Facebook: “Raising three fingers has become a symbol in calling for fundamental political rights.”

Since then, using the salute in public in groups of more than five people has been prohibited through martial law.

V for Vendetta

V for Vendetta holds a special place among films about freedom of speech. In 2005, it was incredibly successful bringing the themes freedom of speech and rebellion against tyranny into the mainstream media debate.

In the film, a freedom fighter plots to overthrow the tyranny ruling on Britain in a dystopian future. The mask he always wears has the features of Guy Fawkes, an English Catholic who attempted to blow up the parliament on 5 November 1605.

The mask has since become an icon. According to The Economist, the mask has become a regular feature of many protests. Among others, it has been adopted by the Occupy movement and Julian Assange, the founder of WikiLeaks.

David Lloyd, author of the graphic novel on which the film is based, has called the mask a “convenient placard to use in protest against tyranny … It seems quite unique, an icon of popular culture being used this way.”

Suffragette

In 2015, the film historical drama Suffragette inspired a protest against the government’s cuts to women services in Britain.

The film shows the struggle for women’s rights that took place in the beginning of the 20th century, when Emmeline Pankhurst led an all-women fight to gain the right to vote.

Before the movie premiere in London’s Leicester Square, activists from the feminist group Sister Uncut broke away from the main crowd, and laid down on the red carpet.

According to The Independent, they chanted “It is our duty to fight for our freedom,” and held signs reading “Dead women can’t vote” and “2 women killed every week” to draw attention to domestic violence and cuts to women’s services.

One protester told The Independent“We’re the modern suffragettes and domestic violence cuts are demonstrating that little has changed for us 97 years later.”

#IndexAwards2016: Ferit Tunç uses inventive methods to challenge censorship in Turkey

Turkish journalist Ferit Tunç quit his advertising job in 2013 to found the newspaper Yön Gazetesi, covering the Kurdish Batman province of Turkey. Since its inception, the newspaper has been the subject of nearly 40 lawsuits, and Tunç has been taken close to bankruptcy.

“Being a journalist in Turkey is very difficult,” he told Index. “But being a journalist in the Eastern provinces of Turkey is more difficult, especially these days.”

However he has refused to give up fighting for press freedom in Turkey. In protest to the crippling lawsuits – all of which had been eventually dropped – Tunç began to devote his front pages to recipes for traditional Turkish dishes.

The recipes contained references to government corruption and media censorship, with readers were informed about the best way to prepare “governor kebab” and a sherbet treat the paper satirically-titled “deputy’s finger.”

“They [the authorities] love to eat so we give them recipes. After they understood our protest, they appropriated the newspaper more than before. We will continue our protest until there is a free local media,” Tunç said.

The protest gained local and international attention, and Tunç eventually won a three-month sponsorship from a group of local businessmen, allowing Yön Gazetesi to stay open.

In 2015 Tunç also ran as an independent parliamentary candidate in Batman in the June general election.

“In reality, my reason for being a candidate was not to be elected, it was completely a reaction towards those in authority and against the political parties,” he said. “During our campaigning our main slogan was “No to Corruption”.

Even his campaign van was emblazoned with the demand: “Stop Corruption!”.

Tunç believes politics and the media need to be reformed in Turkey: “People feel they’re being denied the right to know and discuss local issues, but first, you have to have a form of media that can focus on them without being destroyed.”

“Freedom of speech is essential for me and I am of those that believe that there will not be development, happiness and peace in a place without freedom of speech.”

Recipe: Governor Kebap

The name of the food that I have given in the recipe is “Governor’s Kebap.” The Governor’s Kebap is one of the most expensive foods we have and the poor have not had much of a chance to eat it. And the small message we are giving through this is that while the poor are unable to eat this food, the rich are only thinking about their stomachs while abusing the rights of the poor and dealing corruptly.

– 1 kg boneless leg of lamb
– half kg green beans
– 4-5 tablespoons vegetable oil
– 3 potatoes
– 3 tomatoes
– 2 bell peppers
– a red bell pepper
– 15 pearl onions
– 3 garlic cloves
– 1.5 cups water
– Salt, black pepper, thyme

Preparation:
Peel the garlic cloves. Rub the inside of a stew dish (güveç) with one clove of garlic and then grease it with 1-2 tablespoons of vegetable oil. Peel and wash the vegetables. Cut the beans in half. Slice the potatoes, tomatoes, and peppers. Peel the onions.

Coat the meat with thyme and put it in the stew dish (güveç). In order, add onions, beans, peppers, potatoes, and tomatoes. Add the salt, black pepper, water and remaining oil, and then cover the stew dish (güveç) with aluminum foil. Serve hot after cooking it for one hour in an oven set to 160 degrees.

Index unveils 2016 Freedom of Expression Awards shortlist

An Aleppo-based journalist training women to report on the crisis in war-torn Syria, an Indonesian comic who jokes about Islamic extremism and a 19-year-old campaigner against repression in Eritrea are among those shortlisted for the 2016 Index on Censorship Freedom of Expression Awards.

Drawn from more than 400 crowdsourced nominations, the Index awards shortlist celebrates artists, writers, journalists and campaigners tackling censorship and fighting for freedom of expression. Many of the 20 shortlisted nominees are regularly targeted by authorities or by criminal and extremist groups for their work: some face regular death threats, others criminal prosecution.

Judges for this year’s awards are Nobel Prize-winning author Wole Soyinka, pianist James Rhodes, tech entrepreneur Bindi Karia, Colombian journalist Maria Teresa Ronderos, human rights lawyer Kirsty Brimelow QC and Bahraini campaigner Nabeel Rajab.

“Censorship is not something that happens ‘somewhere else’,” said Jodie Ginsberg, CEO of Index on Censorship. “It occurs on a daily basis in every country, in every part of the world. The shortlist honours those who are among the bravest and most creative in tackling such threats.”

Awards are offered in four categories: journalism; arts; campaigning; and digital activism.

Nominees include Good Chance Theatre who work in the infamous “Jungle” refugee camp in Calais, France; imprisoned Bahraini academic and blogger Dr Abduljalil Al-Singace, who has continued to protest in prison despite being subjected to torture and abuse for daring to speak out on human rights abuses in his country; GreatFire, an anonymous group that battles China’s severe web censorship; and Pravit Rojanaphruk, a veteran reporter who was arrested, interrogated and forced out of his job for criticising Thailand’s military government.

Other nominees include Zaina Erhaim, who returned to her native Syria to report on the conflict and train women to tell unreported stories; Sakdiyah Ma’ruf, a female Muslim stand-up comedian from Indonesia; and campaigner Nkosilathi Emmanuel Moyo, a Zimbabwean who fights corruption in his country, currently in hiding after sending Robert Mugabe a prison uniform for his 92nd birthday this month.

Winners, who will be announced at a gala ceremony in London on 13 April, become Index on Censorship Freedom of Expression Awards Fellows and are given support for their work.

“How do you fight for free expression beyond a moment? How do you keep it alive? You must remember how stressful it is for people on the ground. This fellowship, following us for a year, it is a good idea,” said Rafael Marques de Morais, Freedom of Expression Award winner for Journalism in 2015.
