#IndexAwards2018: Here’s what you need to know

Each year, the Index on Censorship Freedom of Expression Awards gala honours courageous champions who fight for free speech around the world.

Drawn from more than 400 crowdsourced nominations, this year’s nominees include artists, journalists, campaigners and digital activists tackling censorship and fighting for freedom of expression. Many of the 16 shortlisted are regularly targeted by authorities or by criminal and extremist groups for their work: some face regular death threats, others criminal prosecution.

The gala takes place on Thursday 19 April in London and will be hosted by stand-up poet Kate Fox.

Arts

Jamal Ali, Azerbaijan

Jamal Ali is an exiled rap musician with a history of challenging Azerbaijan’s authoritarian regime. Ali was one of many who took to the streets in 2012 to protest spending around the country’s hosting of the Eurovision song contest. Detained and tortured for his role in the protests, he went into exile after his life was threatened. Ali has persisted in challenging the government by releasing music critical of the country’s dynastic leadership. Following the release of one song, Ali’s mother was arrested in a senseless display of aggression. In provoking such a harsh response with a single action, Ali has highlighted the repressive nature of the regime and its ruthless desire to silence all dissent.

Silvanos Mudzvova, Zimbabwe

Playwright and activist Silvanos Mudzvova uses performance to protest against the repressive regime of recently toppled President Robert Mugabe and to agitate for greater democracy and rights for his country’s LGBT community. Mudzvova specialises in performing so-called “hit-and-run” actions in public places to grab the attention of politicians and defy censorship laws, which forbid public performances without police clearance. His activism has seen him be traumatically abducted: taken at gunpoint from his home he was viciously tortured with electric shocks. Nonetheless, Mudzvova has resolved to finish what he’s started and has been vociferous about the recent political change in Zimbabwe.

The Museum of Dissidence, Cuba

The Museum of Dissidence is a public art project and website celebrating dissent in Cuba. Set up in 2016 by acclaimed artist Luis Manuel Otero Alcántara and curator Yanelys Nuñez Leyva, their aim is to reclaim the word “dissident” and give it a positive meaning in Cuba. The museum organises radical public art projects and installations, concentrated in the poorer districts of Havana. Their fearlessness in opening dialogues and inhabiting public space has led to fierce repercussions: Nuñez was sacked from her job and Otero arrested and threatened with prison for being a “counter-revolutionary.” Despite this, they persist in challenging Cuba’s restrictions on expression.

Abbad Yahya, Palestine

Abbad Yahya is a Palestinian author whose novel, Crime in Ramallah, was banned by the Palestinian Authority in 2017. The book tackles taboo issues such as homosexuality, fanaticism and religious extremism. It provoked a rapid official response and all copies of the book were seized. The public prosecutor issued a summons for questioning against Yahya while the distributor of the novel was arrested and interrogated. Yahya also received threats and copies of the book were burned. Despite this, he has spent the last year raising awareness of freedom of expression and the lives of young people in the West Bank and Gaza, particularly in relation to their sexuality.

Campaigning

Egyptian Commission for Rights and Freedoms, Egypt

The Egyptian Commission for Rights and Freedoms is one of the few human rights organisations still operating in a country which has waged an orchestrated campaign against independent civil society groups. Egypt is becoming increasingly hostile to dissent, but ECRF continues to provide advocacy, legal support and campaign coordination, drawing attention to the many ongoing human rights abuses under the autocratic rule of President Abdel Fattah-el-Sisi. Their work has seen them subject to state harassment, their headquarters have been raided and staff members arrested. ECRF are committed to carrying on with their work regardless of the challenges.

National Gay and Lesbian Human Rights Commission, Kenya

The National Gay and Lesbian Human Rights Commission is the only organisation in Kenya challenging and preventing LGBTI discrimination through the country’s courts. Even though homosexuality isn’t illegal in Kenya, homosexual acts are. Homophobia is commonplace and men who have sex with men can be punished by up to 14 years in prison, and while no specific laws relate to women, former Prime Minister Raila Odinga has said lesbians should also be imprisoned. NGLHRC has had an impact by successfully lobbying MPs to scrap a proposed anti-homosexuality bill and winning agreement from the Kenya Medical Association to stop forced anal examination of clients.

Open Stadiums, Iran

The women behind Open Stadiums risk their lives to assert a woman’s right to attend public sporting events in Iran. The campaign challenges the country’s political and religious regime, and engages women in an issue many human rights activists have previously thought unimportant. Iranian women face many restrictions on using public space. Open Stadiums has generated broad support for their cause in and out of the country. As a result, MPs and people in power are beginning to talk about women’s rights to attend sporting events in a way that would have been taboo before.

Team 29, Russia

Team 29 is an association of lawyers and journalists that defends those targeted by the state for exercising their right to freedom of speech in Russia. It is crucial work in a climate where hundreds of civil society organisations have been forced to close and where increasingly tight restrictions have been placed on public protest and political dissent since mass demonstrations rocked Russia in 2012. Team 29 conducts about 50 court cases annually, many involving accusations of high treason. Aside from litigation, they offer legal guides for activists and advice on what to do when summoned by state security for interrogation.

Digital Activism

Digital Rights Foundation, Pakistan

In late 2016, the Digital Rights Foundation established a cyber-harassment helpline that supported more than a thousand women in its first year of operation alone. Women make up only about a quarter of the online population in Pakistan but routinely face intense bullying including the use of revenge porn, blackmail, and other kinds of harassment. Often afraid to report how badly they are treated, women react by withdrawing from online spaces. To counter this, DRF’s Cyber Harassment Helpline team includes a qualified psychologist, digital security expert, and trained lawyer, all of whom provide specialised assistance.

Fereshteh Forough, Afghanistan

Fereshteh Forough is the founder and executive director of Code to Inspire, a coding school for girls in Afghanistan. Founded in 2015, this innovative project helps women and girls learn computer programming with the aim of tapping into commercial opportunities online and fostering economic independence in a country that remains a highly patriarchal and conservative society. Forough believes that with programming skills, an internet connection and using bitcoin for currency, Afghan women can not only create wealth but challenge gender roles and gain independence.

Habari RDC, Congo

Launched in 2016, Habari RDC is a collective of more than 100 young Congolese bloggers and web activists, who use Facebook, Twitter and YouTube to give voice to the opinions of young people from all over the Democratic Republic of Congo. Their site posts stories and cartoons about politics, but it also covers football, the arts and subjects such as domestic violence, child exploitation, the female orgasm and sexual harassment at work. Habari RDC offers a distinctive collection of funny, angry and modern Congolese voices, who are demanding to be heard.

Mèdia.cat, Spain

Mèdia.cat is a Catalan website devoted to highlighting media freedom violations and investigating under-reported stories. Unique in Spain, it was a particularly significant player in 2017 when the disputed independence referendum brought issues of censorship and the impartiality of news under the spotlight. The website provides an online platform that systematically catalogues censorship perpetrated in the region. Its map on censorship offers a way for journalists to report on abuses they have personally suffered.

Journalism

Avispa Midia, Mexico

Avispa Midia is an independent online magazine that prides itself on its use of multimedia techniques to bring alive the political, economic and social worlds of Mexico and Latin America. It specialises in investigations into organised crime and the paramilitaries behind mining mega-projects, hydroelectric dams and the wind and oil industry. Many of Avispa’s reports in the last 12 months have been focused on Mexico and Central America, where the media group has helped indigenous and marginalised communities report on their own stories through audio and video training.

Wendy Funes, Honduras

Wendy Funes is an investigative journalist from Honduras who regularly risks her life for her right to report on what is happening in the country, an extremely harsh environment for reporters. Two journalists were murdered in 2017 and her father and friends are among those who have met violent deaths in the country – killings for which no one has ever been brought to justice. Funes meets these challenges with creativity and determination. For one article she had her own death certificate issued to highlight corruption. Funes also writes about violence against women, a huge problem in Honduras where one woman is killed every 16 hours.

MuckRock, United States

MuckRock is a non-profit news site used by journalists, activists and members of the public to request and share US government documents in pursuit of more transparency. MuckRock has shed light on government surveillance, censorship and police militarisation among other issues.  MuckRock produces its own reporting, and helps others learn more about requesting information. Last year the site produced a Freedom of Information Act 4 Kidz lesson plan to help educators to start discussions about government transparency. Since then, they have expanded their reach to Canada. The organisation hopes to continue increasing their impact by putting transparency tools in the hands of journalists, researchers and ordinary citizens.

Novosti, Croatia

Novosti is a weekly Serbian-language magazine in Croatia. Although fully funded as a Serb minority publication by the Serbian National Council, it deals with a whole range of topics, not only those directly related to the minority status of Croatian Serbs. In the past year, the outlet’s journalists have faced attacks and death threats mainly from the ultra-conservative far-right. For its reporting, the staff of Novosti have been met with protest under the windows of the magazine’s offices shouting fascist slogans and anti-Serbian insults, and told they would end up killed like Charlie Hebdo journalists. Mapping Media Freedom annual report 2017

The case of Maltese journalist Daphne Caruana Galizia, who had for years worked to shine a light on corruption among politicians, businessmen and criminals in Malta, highlights the dire need for a free press. Between 2016 and 2017 Caruana Galizia linked the Maltese political elite to the Panama Papers, including the financial affairs of the prime minister, his wife and the leader of the country’s opposition party.

For her work, she paid with her life when a bomb exploded under her car on 16 October. She was not the only journalist to be murdered in Europe in 2017, nor were violations of media freedom confined to any one region.

Mapping Media Freedom has been recording threats to press freedom since 2014, highlighting the need for protection for journalists. The project monitors the media environment in 42 European and neighbouring countries. In 2017 1,089 reports of limitations to press freedom were verified by a network of correspondents, partners and other sources based in Europe, with a majority of violations coming from official or governmental bodies.

Six journalists were killed during 2017; 178 reports of assault or injury were made; 220 media workers were detained or arrested; 193 reports included criminal charges and lawsuits; there were 367 reports of intimidation, which includes psychological abuse, sexual harassment, trolling/cyberbullying and defamation; in 113 incidents media professionals had their property vandalised or confiscated; there were 178 instances of journalists or sources being blocked; and journalists’ work was altered or censored 68 times.

“While the number of incidents reported to Mapping Media Freedom decreased between 2016 and 2017, this should not be taken as an indication that the work environment for journalists has improved in the countries monitored by the platform,” Hannah Machlin, project manager of Mapping Media Freedom, said. “Media professionals still work under threat of death, assault, prison and harassment, while the law is being abused as a means to silence those who seek to tell the truth.”

ABOUT MAPPING MEDIA FREEDOM

Each report is fact-checked with local sources before becoming publicly available on Mapping Media Freedom. The number of reports per country relates to the number of incidents reported to the map. The data should not be taken as representing absolute numbers. For example, the number of reported incidents of censorship appears low given the number of other types of incidents reported on the map. This could be due to an increase in acts of intimidation and pressure that deter media workers from reporting such cases.

The platform – a joint undertaking with the European Federation of Journalists partially funded by the European Commission – covers 42 countries, including all EU member states, plus Albania, Bosnia and Herzegovina, Iceland, Kosovo, Macedonia, Montenegro, Norway, Serbia, Turkey, along with Russia, Belarus and Ukraine (added in April 2015), and Azerbaijan (added in February 2016). The database uses Ushahidi, an open source software to map and categorise incidents.

Six journalists were killed as a result of their reporting in 2017.

Q1: In Russia on 9 March, two unknown individuals approached Nikolai Andrushchenko, an investigative journalist for the weekly newspaper Novyi Petersburg, near his home in St. Petersburg and demanded that he surrender documents and materials from his ongoing investigation into abuses of power by police officers. After the journalist refused, he was physically assaulted by the assailants, who were not apprehended. Andrushchenko refused to file a complaint with the police. A second assault took place a few days later, after which he was found unconscious near his apartment. The journalist never regained consciousness and, following brain surgery, died in hospital as a result of his injuries on 19 April.

On 16 March, in Ulan-Ude, Russia, Yevgeny Khamaganov, the editor-in-chief of Asia-Russia Daily and The Site of the Buryat People died in unexplained circumstances. The cause of death is unclear and no official response has been made. According to local media, Khamaganov was taken to hospital on 10 March because of his diabetes, fell into a coma and died several days later. Some reports cited speculation that he was instead hospitalised after being beaten by unknown assailants. Khamaganov was known for articles critical of the Russian federal government’s policies.

Q2: In Minusinsk, Russia, journalist Dmitri Popkov, editor-in-chief and founder of local newspaper Ton-M, was shot five times and killed on 24 May. His body was found in a sauna in his backyard. Prior to his death, Popkov had told RFE/RL that his newspaper became “an obstacle” for local officials who are now “threatening and intimidating journalists”.

Q3: On 10 August Swedish freelance journalist Kim Wall boarded an experimental submarine in Copenhagen, Denmark, to profile the vessel’s Danish inventor. The following morning, the submarine sank under suspicious circumstances. Peter Madsen, the inventor, told police he had set Wall ashore before the incident. However, between August and October, Wall’s dismembered remains were found washed ashore. Madsen has been charged with the journalist’s murder and with sexual assault.

On 22 September Syrian journalists Orouba Barakat and her daughter Halla Barakat were found dead in their apartment in Istanbul, Turkey. The exact date of the murders is unknown. Orouba Barakat, a journalist, filmmaker and activist, was outspokenly critical of the Syrian regime. Her daughter was a reporter for Alekhbarya TV, news editor for the Orient and a former editor at Turkish state channel TRT World. The pair had received threats from groups associated with the Syrian government. Police reports said they were strangled and then stabbed. The murders are still being investigated by police.

Q4: Maltese journalist Daphne Caruana Galizia was killed when the car she was driving exploded in Bidnija, near Mosta. Caruana Galizia had filed a police report 15 days earlier saying she was being threatened. The journalist had conducted a series of high-profile corruption investigations in Malta and was being sued in relation to her work. 

One additional media worker was killed in 2017. On 29 April Saeed Karimian, an Iranian television executive, was shot and killed along with his partner in Istanbul, Turkey.

Mapping Media Freedom documented 175 verified incidents of assault and injury, 109 of which occurred in just five countries: Russia (47), Spain (19), Ukraine (18), Italy (15) and France (10).

On 14 September Taras Khalyava, a local YouTube blogger, was assaulted by three unidentified people near his apartment in Dobropillye, Ukraine. The assailants knocked him to the ground, kicked him and beat him on the head with a steel rod. “I survived because I was wearing a bicycle helmet,” Khalyava told Novosti Donbassa. The blogger has said the attack was related to his work.

On 10 October, Drago Miljus, a Croatian journalist for the news website Index.hr, was pushed by a police officer, who then took his mobile phone and threw it into the sea. Another officer hit the journalist on the head, knocking him to the ground. The incident happened at a beach in Split, where Miljus was covering a story about a man who claimed to have a bomb.

On 23 October, a man broke into Echo Moskvy’s office in the centre of Moscow, Russia, and stabbed programme host Tatiana Felgengauer, who is also one of the editor-in-chief’s deputies, several times in the neck. Felgengauer was hospitalised in a critical condition and underwent several operations. The attacker was sent for psychiatric evaluation.

A total of 216 journalists were arrested or detained in 2017, including 21 in Azerbaijan. On 5 July Afgan Mukhtarli was kidnapped from Georgia, where he had lived in self-imposed exile for three years, and taken to Azerbaijan. While in prison, he suffered serious health problems and lost a significant amount of weight. In January 2018 he was sentenced to six years in prison by an Azerbaijani court.

Mapping Media Freedom verified the arrest or detainment of 65 journalists in Russia throughout 2017. The majority of these took place during anti-corruption protests throughout the country organised by opposition figure Alexei Navalny in March and June.

By the close of 2017, 151 journalists were in prison in Turkey, making the country the largest jailer of journalists in the world. On 20 October police took five journalists working for the Kurdish Jin News and Mesopotamia agencies into custody: Jin News editor Sibel Yükler; Jin News reporters Duygu Erol and Habibe Eren; and Mezopotamya Agency reporters Diren Yurtsever and Selman Güzelyüz. Both agencies were launched in late September by staff from organisations shut down during Turkey’s state of emergency.

While only five media workers were arrested or detained in 2017 in the United Kingdom, one case stands out. On 7 December two Kurdish women and two 17-year-old boys were arrested at dawn by armed police in Alexandra Palace and in Crouch End, London. They were questioned about the sale and distribution of the Kurdish-language Yeni Ozgur Politika. All four were arrested on suspicion of funding terrorism, money laundering and fraud.

[/vc_column_text][vc_custom_heading text=”Criminal charges/civil lawsuits” use_theme_fonts=”yes”][vc_column_text]

There were 192 cases of criminal charges or civil litigation reported to Mapping Media Freedom in 2017. In Italy, lawsuits demanding millions of euros in damages were filed throughout the year. In March Claudio Riva, former owner of the steelworks company Ilva, sued newspaper Gazzetta del Mezzogiorno for €2.2 million in damages, for publishing an article about pollution allegedly linked to the company’s operations in Taranto. Riva’s lawyers asked for €550,000 in compensation for each of the four damaged parties: Riva Forni Elettrici SPA, Claudio Riva, Fabio Arturo Riva and Nicola Riva. In October Il Locale News was sued for €1 million by Giancarlo Guarrera, an engineer and director of Airgest, the company that manages Trapani airport in Sicily. On 8 November 2016 Il Locale News featured an article on financial issues at Airgest.

In Spain, wealthy businessman Alvaro de Marichalar filed legal action against freelance journalist Sabina Urraca in March, demanding she pay €30,000 in damages for an article she wrote after accompanying him on a trip. In July Hermann Tertsch, a columnist for daily newspaper ABC, was ordered by a court in Zamora to pay €12,000 to Javier Iglesias for “unlawfully offending the honour” of his father Manuel. Javier Iglesias is the father of Pablo Iglesias, the leader of the left-wing Podemos party, the third largest party in the Spanish parliament.

[/vc_column_text][vc_custom_heading text=”Legal measures” use_theme_fonts=”yes”][vc_column_text]

There were 112 legal measures taken against journalists in 2017. In the United Kingdom, the offshore company Appleby, which was at the heart of the Panama Papers scandal, launched breach of confidence proceedings against the Guardian and the BBC on 18 December, in an attempt to force them to disclose the documents used in the investigation. Appleby said the documents were stolen in a cyberattack and there was no public interest in the revealing of their contents.

In February the UK government proposed extending jail time for journalists who have obtained leaked official documents to up to 14 years. The major overhaul of the Official Secrets Act – to be replaced by an updated Espionage Act – would give courts the power to increase jail terms against journalists receiving such material. Should the law get approval, documents containing “sensitive information” about the economy could fall foul of national security laws for the first time. Jodie Ginsberg, chief executive of Index on Censorship, said: “It is unthinkable that whistleblowers and those to whom they reveal their information should face jail for leaking and receiving information that is in the public interest.”

In November, after the US added several media outlets funded by the Russian state on a list of foreign agents, Russia adopted a new restrictive law against foreign media that allows such journalists and organisations to be recognised as foreign agents, which makes them subject to numerous additional checks and obliges them to mark their content as being produced by a foreign agent.

There were 51 reports of job loss recorded on Mapping Media Freedom throughout 2017, more than half of which came from Russia (13), Poland (8) and Spain (5).

In Poland, Michał Fabisiak, a journalist for the public media outlet Polskie Radio, was fired for refusing to reveal the source of information for an article about an alleged internal survey in the Law and Justice (PiS) party, measuring support for potential PiS candidates in municipal elections in 2018.

Eleven days later, Barbara Burdzy, a Polish journalist for the public media outlet TVP Info, was dismissed after she published an article stating that the intelligence service, under the minister of defence Antoni Macierewicz, lied when claiming that deputy minister Jacek Kotas was not involved in property restoration in Warsaw.

On 14 December a documentary critical of Togo’s president was removed from the website of the French cable television channel Canal Plus and two employees of the channel were subsequently dismissed. Faure Gnassingbé, the president of Togo, is a friend of Vincent Bolloré, French businessman and chairman of Canal Plus’ parent company Vivendi. The documentary, entitled Let Go of the Throne, focused on ongoing protests against the country’s president. In November it was aired on Canal Afrique, a decision attributed to an employee who was later fired. François Deplanck, head of channels and content at Canal Plus International was also dismissed.

Intimidation was widespread across Europe in 2017, with 275 incidents reported to the map. In the United Kingdom, the BBC’s political editor Laura Kuenssberg was assigned a security detail at the Labour party conference in late September following online threats and abuse. The journalist attracted anger from some Labour supporters for her coverage of the 2016 Labour leadership race and the party’s poor performance in local elections, while a petition for her to be fired received 35,000 signatures.

Kuenssberg — the first woman to lead political coverage at the public broadcaster — also reported that she had bolstered her security during the general election in June 2017 after receiving threats over her coverage of Labour Party leader Jeremy Corbyn.

Media workers received a total of 37 death threats throughout Europe in 2017, including in Serbia where, on 11 September, journalists for the news portal Maglocistac were told in a letter they would be “slaughtered like rabbits”. The comment was among others left by anonymous individuals below an article published on 4 September on threats the mayor of Subotica made to one of his party colleagues. In France, the satirical magazine Charlie Hebdo received death threats on 4 November after featuring a caricature of the theologian Tariq Ramadan on its front cover.

[/vc_column_text][vc_custom_heading text=”Attacks to property” use_theme_fonts=”yes”][vc_column_text]

There were 109 attacks on the property of journalists in 2017. On the morning of 26 November Yulia Zavialova, editor-in-chief of the Russian investigative website Bloknot Volgograd, known for its coverage of political and business corruption, asked her father to have the tires on her car checked. Thirty minutes later he rang her to say the brakes were completely out of service. Her brakes had been cut and her anti-lock braking system was damaged. Zavialova called the police but, according to the journalist, they did not properly investigate the scene, failing to take fingerprints or full details of the damage.

Supporters of the Italian far-right party Forza Nuova attacked the offices of the left-wing newspaper La Repubblica in Rome on 6 December. The party declared “war” on L’Espresso Group, the newspaper’s publisher, through a Facebook post. During the protest, Forza Nuova supporters threw flares at La Repubblica’s office while carrying a banner reading “Boycott L’Espresso and La Repubblica”. Members of the group read a statement denouncing journalists employed there.

In Greece, a group of hooded men ransacked the Thessaloniki offices of the Union of Newspaper Journalists of Macedonia and Thrace on 21 December. The assailants smashed computers and scattered leaflets with slogans vilifying the organisation.

There were 169 confirmed cases of blocked access throughout Europe in 2017, in which journalists were expelled from a location or prevented from speaking to a source by way of obstruction. Many of these reports were connected to other violations, such as assault, damage to property and intimidation.

Throughout Europe, journalists were blocked from attending events by political parties, including the Labour Party’s annual conference in Brighton, United Kingdom, in September. Sussex police refused to grant Huck Magazine news editor Michael Segalov the security clearance he needed to attend. The journalist had applied for press accreditation three months prior but was informed on 19 September that it had been denied by police on security grounds. “Rather than provide reasons and rationale for our journalistic freedom being curtailed, the police said they would not divulge why they made their call,” Segalov wrote. The journalist has never been arrested, charged or convicted of a crime. Michael Walker, a journalist working for the left-wing Novara Media, was also barred by police from entering the conference.

On 25 October three journalists working for Echo TV in Hungary were banned from entering the country’s parliament. The parliament press office said the journalists had broken official rules multiple times by filming in areas closed to the media.

In 2017 Mapping Media Freedom documented 81 cases in which journalists had their work censored or altered. On 15 October in the city of Uppsala, Sweden, local newspaper UNT and public broadcaster SVT identified what they saw as a concerted effort by press officers at the local council to control statements made by staff to journalists. Both complained that press officers were exerting pressure on staff to change statements that reflect badly on the council.

On 4 November the Spanish newspaper El País removed a column from its website that questioned and criticised allegations of sexual harassment in the film industry against the likes of Kevin Spacey, Harvey Weinstein and Roman Polanski.

On 19 December the Malta Independent, a Maltese newspaper and publishing house, announced it would remove some online content relating to a whistleblower at Pilatus Bank due to the threat of a multi-million euro lawsuit from the bank. Pilatus Bank first threatened the independent publishing house in mid-October, with lawsuits in the USA and United Kingdom.

2018 WATCH LIST

Index on Censorship is especially disturbed by the five countries on the map with over 60 violations in 2017. These are:

Russia (197)

During protests organised by Russian lawyer and activist Alexei Navalny in March and June, 1,000 people were arrested, including 19 journalists, in Moscow, St. Petersburg, Makhachkala, Petrozavodsk and Samara. At a rally in Moscow on 26 March, police detained RBC correspondent Timofey Dzyadko, Mediazona publisher Piotr Verzilov, Open Russia correspondent Sofiko Arifdzhanova, Public Television of Russia journalist Olga Orlova, Echo of Moscow journalist Alexandr Pluschev and Kommersant-FM reporter Pyotr Parkhomenko. At the same rally, Guardian correspondent Alec Luhn was detained after he took a photo of a protester being arrested. He spent more than five hours at a police station without an explanation of why he was detained. Luhn was eventually charged with participating in an unsanctioned rally, even though he showed officers his press accreditation. At least nine media workers were detained across Russia on 8 October during further protests organised by Navalny.

Police detained journalists working for the independent newspaper Novaya Gazeta on 8 March for reporting on a demonstration to mark International Women’s Day on the Red Square in the centre of Moscow.

On 20 December photographers Andrey Zolotov and Denis Bochkarev, along with Maria Alyokhina, a member of punk collective Pussy Riot, were detained during a protest at the entrance of the FSB, the Russian federal security service. All three were taken to the nearest police station, where Alyokhina and Bochkaryov spent the night ahead of an administrative hearing.

Often referred to as the only independent radio station in Russia, Echo Moskvy was subjected to significant pressure and harassment throughout 2017, with Mapping Media Freedom verifying 15 reports against the station including one radio host stabbed, two journalists fleeing the country after threats, several detained and an American company forced to withdraw funding from the station.

Turkey

Although the number of violations reported to Mapping Media Freedom that took place in Turkey decreased between 2016 and 2017 — from 231 to 135 — the country remains the number one jailer of journalists in the world with 151 media workers behind bars by the end of 2017. In all, 65 journalists were jailed and sentenced on charges including the spreading of terrorist propaganda. At the trial of journalist Nedim Türfent, who reported on security operations in Turkey’s Kurdish majority provinces, at least a dozen people claimed they were tortured by police.

In November, Turkish journalists Ahmet Altan and Mehmet Altan’s defence attorneys were forced to leave the courtroom as their clients stood trial, accused of taking part in Turkey’s failed 2016 coup. Both brothers are prominent Turkish journalists, known for their critical reporting on president Erdogan’s regime. Without lawyers present, the court then ruled that the Altan brothers — along with four other journalists — would remain in pretrial detention. On 16 February 2018 they were sentenced to aggravated life sentences.

Belarus

A total of 92 violations of media freedom were recorded in Belarus throughout 2017, including the detainment of 101 journalists. In all, 30 journalists received criminal charges. A wave of detentions occurred on the Belarusian holiday Freedom Day on 25 March, when 36 journalists were placed in custody. Olga Morva, Philip Warwick, Andrey Dubinin, Valery Shchukin, Katsiaryna Bakhvalava, Ihar Ilyash and Volha Davydava said they were beaten by police while under arrest. Warwick, from the United Kingdom, said he was denied the right to contact his embassy after being handcuffed and hit in the face; he spent over six hours at the police station. The apartment of journalist Maryna Kastylyanchanka, who works with human rights organisations, was searched. She was later jailed for 15 days for disobeying police and participating in the unsanctioned mass protests.

Throughout the year, 69 fines were administered to journalists for violating Article 22.9 of Belarus’ Code of Administrative Offences on the illegal production and/or distribution of media content.

Ukraine

In all, 74 violations against the media in Ukraine were reported to Mapping Media Freedom in 2017. One of the most worrying trends included the treatment of foreign journalists or journalists working for Russian companies. Sixteen journalists were expelled from, or not allowed to enter the country, including some who worked for Russian state media outlets. There were three cases involving the abuse of Interpol warrants to arrest or detain foreign journalists in Ukraine by their countries of origin as a means of silencing critical voices. These were: Azerbaijan, Uzbekistan and Kazakhstan. Three journalists were arrested in territory controlled by self-proclaimed separatists in 2017, including Ukrainian blogger and writer Stanyslav Aseev, one of the few journalists contributing to western and independent media outlets in eastern Ukraine.

Ukrainian president Petro Poroshenko signed a National Security and Defence Council decree in May that banned a number of Russian social media sites such as VKontakte and Odnoklassniki, along with the search engine Yandex and email service Mail.ru.

“The lack of safety for journalists in Ukraine, whether direct attacks or obstruction, remains a problem, and the level of response by the authorities is telling because too often the perpetrators go unpunished,” Vitalii Atanasov, Mapping Media Freedom correspondent for Ukraine, said. “The murder of prominent journalist Pavel Sheremet in July 2016 has not yet been properly investigated, while media workers continue to face pressure from the authorities, politicians and other influential actors. It is important to emphasise to that while the Mapping Media Freedom reflects the most disturbing and characteristic cases, it does not claim to be complete.”

Spain

Between 2016 and 2017, media freedom violations in Spain increased from 56 to 66. Journalists experienced difficulties before, during and after the referendum on Catalan independence on 1 October. In July the daily newspaper La Vanguardia, based in Barcelona, refused to publish a column written by Gregorio Morán in which the journalist criticised the “corrupt” regional government of Catalonia. Morán also accused the Catalan media of receiving sums of public money, adding that it was therefore no surprise to see them supporting Catalan independence.

On the day of the referendum Mapping Media Freedom recorded five separate violations of media freedom. Journalists were among the many victims of violence by heavy-handed police deployed the Spanish government, who declared the referendum to be illegal. Xabi Barrena, a journalist for the newspaper El Periódico, was assaulted by Spanish national police while reporting on voters being evicted from a polling station in Barcelona. He was struck with a baton, knocked to the ground and kicked by police.

In the days following the referendum, media violations were widespread during the protests that swept parts of the country. On 2 October, for example, Ana Cuesta and José Yelámo, reporters for television La Sexta, were surrounded by protesters who chanted “Spanish press manipulators” and “assassins” during live coverage.

TRENDS

Threats from the far-right

The far right has a record of violating freedom of the press throughout Europe, with 24 media violations across 13 countries involving far-right groups or activists in 2017.

Twelve attempts were made by the far-right to intimidate media workers. At the start of December, the Serbian journalist Marija Antic, a television host for the broadcaster N1, received death and rape threats on social media after interviewing a French-Serbian far-right activist. Antic had invited Arnaud Gouillon, who is known for his support for Serbs in Kosovo, to her talk show. During the interview, Antic asked him about his past involvement in the French far-right group Les Identitaires and about his connections with far-right Serbian groups after he attended some of their events. After the interview, Gouillon accused Antic of demonising him. Soon after, Antic received multiple threats on social media.

On six occasions, far-right groups attempted to defame journalists throughout Europe. This was the case on 15 March when Stina Blomgren, a Swedish journalist working for the state broadcaster SVT, was accused by the popular Swedish-Russian far-right blogger Egor Putilov of lying and creating fake reports about the risks Syrian migrants faced when trying to reach Sweden. Putilov claimed to have visited Egypt and uncovered inaccuracies in an article published by Blomgren in August.

In 2017 four reports made to Mapping Media Freedom involved violence from the far right and four involved attacks to property. These ranged from damages to camera equipment to an assault with a metal pipe.

Corruption

Corruption is a major issue in the EU and neighbouring countries, undermining democracy and putting people at risk. Journalists play a key role in uncovering and fighting corruption through their investigations and, as a result, put themselves in danger. In all, 67 cases of media workers facing difficulty in their reporting on corruption were recorded throughout 2017.

On 16 August, for instance, Parim Olluri, editor-in-chief of investigative website Insajderi, was physically assaulted by unknown individuals outside his home in Kosovo’s capital Pristina. Olluri believes the attack was linked to his work. A few days before the assault, Olluri had published an editorial about corruption allegations against former Kosovo Liberation Army commanders, after which he received a torrent of abuse and threats on social media.

On 16 October the Maltese journalist Daphne Caruana Galizia was murdered when the car she was driving exploded. On 11 March Silvio Debono, owner of real estate investment company DB Group, filed 19 libel cases against her. Caruana Galizia published a number of articles on her blog discussing a business deal between the developer and Malta’s government to take over a tract of public land on which he had planned to build a Hard Rock Hotel and two towers of flats for sale. Caruana Galizia also conducted an investigation allegedly linking prime minister Joseph Muscat and his wife to the Panama Papers scandal.

In 2017 police came no closer to identifying the perpetrators behind the 2016 murder of prominent Radio Vesti and Ukrayinska Pravda journalist Pavel Sheremet. Despite promises, no new data on the investigation was made public.

Harassment of female journalists

Mapping Media Freedom logged 10 cases where women journalists reported they suffered sexual harassment throughout 2017, from politicians, anonymous sources and fellow journalists alike. In February the Swedish newspaper journalist Evelyn Schreiber was subjected to persistent death threats and threats of sexual violence after questioning local police officer a Peter Springare’s assertion that immigrants were responsible for a spike in violent crime in Örebro, Sweden. Within 24 hours of her report, Schreiber received over 200 emails containing threats.

On 7 May Loes Reijmer, a journalist and columnist for the Dutch daily newspaper De Volkskrant, faced abuse after the popular right-wing blog GeenStijl published a photo of her with the text: “Would you do her?” Thousands of readers responded in the comments section, many containing sexual references and rape threats. Reijmer had published several articles critical of GeenStijl, which is owned by Telegraaf Media Group and is one of the top 10 most popular news sites in the Netherlands.

On 30 November, Dzenan Selimbegovic, a deputy secretary general of the presidency of Bosnia and Herzegovina, used offensive language to describe Sanele Prašović Gadžo, a journalist for the public broadcaster BHT, and Arijana Saračević-Helać, a journalist for the public broadcaster FTV, in a Facebook post. The comments followed a trailer aired on BHT for Gadžo’s interview with Saračević-Helać on her talk show.

Commercial interference

In 2017 Index on Censorship added the “commercial interference” category to Mapping Media Freedom to monitor actions that use money and/or financial pressure to influence editorial decisions of a media or news outlet. One of the most concerning issues highlighted was the lack of plurality in media ownership in Ireland and the impact this can have on the public’s right to information.

Broadcasting in the country is dominated by just two organisations, RTÉ and Communicorp. Semi-state RTÉ services are the most popular on television and radio, while businessman Denis O’Brien’s Communicorp owns the largest commercial news radio stations – Newstalk and Today FM, among others. There is currently a lack of imperative for reform on the issue of the concentration of media ownership by the Irish government, leaving journalists open to further pressure and self-censorship to suit commercial interests, according to the National Union of Journalists.

Across Europe commercial interference in the media is proving to be a growing problem. On 6 December in Nantes, France, for example, managers of McDonald’s restaurants were asked to remove a page from local newspaper Ouest France that contained an article about litigation between the fast food restaurant chain and two of its workers, who had campaigned for union representation.

CONCLUSIONS AND RECOMMENDATIONS

Mapping Media Freedom’s annual report highlights issues affecting the state of press freedom throughout Europe in 2017. Index on Censorship urges that the following steps be taken.

  • All journalists, media workers and others arrested for exercising their right to freedom of expression must be immediately and unconditionally released. We make this plea directly to the Turkish government in particular, which has become the largest jailer of journalists not just among the countries monitored by Mapping Media Freedom, but the entire world.

  • Laws designed to impinge on the work of journalists must be reconsidered, whether amended or abolished. This includes defamation laws, hate speech laws and terror and security-related legislation. Lawmakers should also ensure that new or revised laws do not encroach on the work of journalists.

  • Governments must respect the right of journalists to protect confidential information and sources. This is vital, especially in cases involving whistleblowing in the public interest.

  • Harassment and crimes against journalists must be properly investigated and those responsible should be prosecuted to prevent the further proliferation of impunity.

  • Governments should do more to ensure the protection of media workers who are women.

#IndexAwards2018: Champions of free expression shortlist announced

  • Judges include Serpentine CEO Yana Peel; BBC journalist Razia Iqbal
  • Sixteen courageous individuals and organisations who fight for freedom of expression in every part of the world

An exiled Azerbaijani rapper who uses his music to challenge his country’s dynastic leadership, a collective of Russian lawyers who seek to uphold the rule of law, an Afghan seeking to economically empower women through computer coding and a Honduran journalist who goes undercover to expose her country’s endemic corruption are among the courageous individuals and organisations shortlisted for the 2018 Index on Censorship Freedom of Expression Awards Fellowships.

Drawn from more than 400 crowdsourced nominations, the shortlist celebrates artists, writers, journalists and campaigners overcoming censorship and fighting for freedom of expression against immense obstacles. Many of the 16 shortlisted nominees face regular death threats, others criminal prosecution or exile.

“Free speech is vital in creating a tolerant society. These nominees show us that even a small act can have a major impact. These groups and individuals have faced the harshest penalties for standing up for their beliefs. It’s an honour to recognise them,” said Jodie Ginsberg, CEO of campaigning nonprofit Index on Censorship.

Awards fellowships are offered in four categories: arts, campaigning, digital activism and journalism.

Nominees include rapper Jamal Ali who challenged the authoritarian Azerbaijan government in his music – and whose family was targeted as a result; Team 29, an association of lawyers and journalists that defends those targeted by the state for exercising their right to freedom of speech in Russia; Fereshteh Forough, founder and executive director of Code to Inspire, a coding school for girls in Afghanistan; Wendy Funes, an investigative journalist from Honduras who regularly risks her life for her right to report on what is happening in the country.

Other nominees include The Museum of Dissidence, a public art project and website celebrating dissent in Cuba; the National Gay and Lesbian Human Rights Commission, a group proactively challenging LGBTI discrimination through the Kenya’s courts; Mèdia.cat, a Catalan website highlighting media freedom violations and investigating under-reported or censored stories; Novosti, a weekly Serbian-language magazine in Croatia that deals with a whole range of topics.

Judges for this year’s awards, now in its 18th year, are BBC reporter Razia Iqbal, CEO of the Serpentine Galleries Yana Peel, founder of Raspberry Pi CEO Eben Upton and Tim Moloney QC, deputy head of Doughty Street Chambers.

Iqbal says: “In my lifetime, there has never been a more critical time to fight for freedom of expression. Whether it is in countries where people are imprisoned or worse, killed, for saying things the state or others, don’t want to hear, it continues to be fought for and demanded. It is a privilege to be associated with the Index on Censorship judging panel.”

Winners, who will be announced at a gala ceremony in London on 19 April, become Index on Censorship Freedom of Expression Awards Fellows and are given year-long support for their work, including training in areas such as advocacy and communications.

“This award feels like a lifeline. Most of our challenges remain the same, but this recognition and the fellowship has renewed and strengthened our resolve to continue reporting, especially on the bleakest of days. Most importantly, we no longer feel so alone,” 2017 Freedom of Expression Awards Journalism Fellow Zaheena Rasheed said.

ARTS

Jamal Ali
Azerbaijan
Jamal Ali is an exiled rapper and rock musician with a history of challenging Azerbaijan’s authoritarian regime. Ali was one of many who took to the streets in 2012 to protest spending around the country’s hosting of the Eurovision song contest. Detained and tortured for his role in the protests, he went into exile after his life was threatened. Ali has persisted in releasing music critical of the country’s dynastic leadership. Following the release of one song, Ali’s mother was arrested in a senseless display of aggression. In provoking such a harsh response with a single action, Ali has highlighted the repressive nature of the regime and its ruthless desire to silence all dissent.

Silvanos Mudzvova
Zimbabwe
Playwright and activist Silvanos Mudzvova uses performance to protest against the repressive regime of recently toppled President Robert Mugabe and to agitate for greater democracy and rights for his country’s LGBT community. Mudzvova specialises in performing so-called “hit-and-run” actions in public places to grab the attention of politicians and defy censorship laws, which forbid public performances without police clearance. His activism has seen him be traumatically abducted: taken at gunpoint from his home he was viciously tortured with electric shocks. Nonetheless, Mudzvova has resolved to finish what he’s started and has been vociferous about the recent political change in Zimbabwe.

The Museum of Dissidence
Cuba
The Museum of Dissidence is a public art project and website celebrating dissent in Cuba. Set up in 2016 by acclaimed artist Luis Manuel Otero Alcántara and curator Yanelys Nuñez Leyva, their aim is to reclaim the word “dissident” and give it a positive meaning in Cuba. The museum organises radical public art projects and installations, concentrated in the poorer districts of Havana. Their fearlessness in opening dialogues and inhabiting public space has led to fierce repercussions: Nuñez was sacked from her job and Otero arrested and threatened with prison for being a “counter-revolutionary.” Despite this, they persist in challenging Cuba’s restrictions on expression.

Abbad Yahya
Palestine
Abbad Yahya is a Palestinian author whose fourth novel, Crime in Ramallah, was banned by the Palestinian Authority in 2017. The book tackles taboo issues such as homosexuality, fanaticism and religious extremism. It provoked a rapid official response and all copies of the book were seized. The public prosecutor issued a summons for questioning against Yahya while the distributor of the novel was arrested and interrogated. Yahya also received threats on social media and copies of the book were burned. Despite this, he has spent the last year giving interviews to international and Arab press and raising awareness of freedom of expression and the lives of young people in the West Bank and Gaza, particularly in relation to their sexuality.

CAMPAIGNING

Egyptian Commission for Rights and Freedoms
Egypt
The Egyptian Commission for Rights and Freedoms or ECRF is one of the few human rights organisations still operating in a country which has waged an orchestrated campaign against independent civil society groups. Egypt is becoming increasingly hostile to dissent, but ECRF continues to provide advocacy, legal support and campaign coordination, drawing attention to the many ongoing human rights abuses under the autocratic rule of President Abdel Fattah-el-Sisi. Their work has seen them subject to state harassment, their headquarters have been raided and staff members arrested. ECRF are committed to carrying on with their work regardless of the challenges.

National Gay and Lesbian Human Rights Commission
Kenya
The National Gay and Lesbian Human Rights Commission is the only organisation in Kenya proactively challenging and preventing LGBTI discrimination through the country’s courts. Even though being homosexual isn’t illegal in Kenya, homosexual acts are. Homophobia is commonplace and men who have sex with men can be punished by up to 14 years in prison, and while no specific laws relate to women, former Prime Minister Raila Odinga has said lesbians should also be imprisoned. NGLHRC has had an impact by successfully lobbying MPs to scrap a proposed anti-homosexuality bill and winning agreement from the Kenya Medical Association to stop forced anal examination of clients “even in the guise of discovering crimes.”

Open Stadiums
Iran
The women behind Open Stadiums risk their lives to assert a woman’s right to attend public sporting events in Iran. The campaign that challenges the country’s political and religious regime, and engages women in an issue many human rights activists have previously thought unimportant. Iranian women face many restrictions on using public space. Open Stadiums has generated broad support for their cause in and out of the country. As a result, MPs and people in power are beginning to talk about women’s rights to attend sporting events in a way that would have been taboo before.

Team 29
Russia
Team 29 is an association of lawyers and journalists that defends those targeted by the state for exercising their right to freedom of speech in Russia. It is crucial work in a climate where hundreds of civil society organisations have been forced to close and where increasingly tight restrictions have been placed on public protest and political dissent since mass demonstrations rocked Russia in 2012. Team 29 conducts about 50 court cases annually, many involving accusations of high treason. Aside from litigation, they offer legal guides for activists, advice on what to do when state security comes for you and how to conduct yourself under interrogation.

DIGITAL ACTIVISM

Digital Rights Foundation
Pakistan
In late 2016, the Digital Rights Foundation established a cyber-harassment helpline that supported more than a thousand women in its first year of operation alone. Women make up only about a quarter of the online population in Pakistan but routinely face intense bullying including the use of revenge porn,​ ​blackmail, and other kinds of ​harassment. Often afraid to report how badly they are treated, women react by withdrawing from online spaces. To counter this, DRF’s Cyber Harassment Helpline team includes a qualified psychologist, digital security expert, and trained lawyer, all of whom provide specialised assistance.

Fereshteh Forough
Afghanistan
Fereshteh Forough is the founder and executive director of Code to Inspire, a coding school for girls in Afghanistan. Founded in 2015, this innovative project helps women and girls learn computer programming with the aim of tapping into commercial opportunities online and fostering economic independence in a country that remains a highly patriarchal and conservative society. Forough believes that with programming skills, an internet connection and using bitcoin for currency, Afghan women can not only create wealth but challenge gender roles and gain independence.

Habari RDC
Congo
Launched in 2016, Habari RDC is a collective of more than 100 young Congolese bloggers and web activists, who use Facebook, Twitter and YouTube to give voice to the opinions of young people from all over the Democratic Republic of Congo. Their site posts stories and cartoons about politics, but it also covers football, the arts and subjects such as domestic violence, child exploitation, the female orgasm and sexual harassment at work. Habari RDC offers a distinctive collection of funny, angry and modern Congolese voices, who are demanding to be heard.

Mèdia.cat
Spain
Mèdia.cat is a Catalan website devoted to highlighting media freedom violations and investigating under-reported or censored stories. Unique in Spain, it was a particularly significant player in 2017 when the heightened atmosphere in Catalonia over the disputed independence referendum brought issues of censorship and the impartiality of news under the spotlight. The website provides an online platform that catalogues systematically, publicly and in real time censorship perpetrated in the region. Its map on censorship offers a way for journalists to report on abuses they have personally suffered.

Avispa Midia
Mexico
Avispa Midia is an independent online magazine that prides itself on its daring use of multimedia techniques to bring alive the political, economic and social worlds of Mexico and Latin America. It specialises in investigations into organised criminal gangs and the paramilitaries behind mining mega-projects, hydroelectric dams and the wind and oil industry. Many of Avispa’s reports in the last 12 months have been focused on Mexico and Central America, where the media group has helped indigenous and marginalised communities report on their own stories by helping them learn to do audio and video editing. In the future, Avispa wants to create a multimedia journalism school to help indigenous and young people inform the world what is happening in their region, and break the stranglehold of the state and large corporations on the media.

Wendy Funes
Honduras
Wendy Funes is an investigative journalist from Honduras who regularly risks her life for her right to report on what is happening in the country, an extremely harsh environment for reporters. Two journalists were murdered in 2017 and her father and friends are among those who have met violent deaths in the country – killings for which no one has ever been brought to justice. Funes meets these challenges with creativity and determination. For one article she had her own death certificate issued to highlight corruption. Funes also writes about violence against women, a huge problem in Honduras where one woman is killed every 16 hours.

United States
MuckRock is a non-profit news site used by journalists, activists and members of the public to request and share US government documents in pursuit of more transparency. MuckRock has shed light on government surveillance, censorship and police militarisation among other issues.  MuckRock produces its own reporting, and helps others learn more about requesting information. Last year the site produced a Freedom of Information Act 4 Kidz lesson plan to help educators to start discussions about government transparency. Since then, they have expanded their reach to Canada. The organisation hopes to continue increasing their impact by putting transparency tools in the hands of journalists, researchers and ordinary citizens.

Novosti
Croatia
Novosti is a weekly Serbian-language magazine in Croatia. Although fully funded as a Serb minority publication by the Serbian National Council, it deals with a whole range of topics, not only those directly related to the minority status of Croatian Serbs. In the past year, the outlet’s journalists have faced attacks and death threats mainly from the ultra-conservative far-right. For its reporting, the staff of Novosti have been met with protest under the windows of the magazine’s offices shouting fascist slogans and anti-Serbian insults, and told they would end up killed like Charlie Hebdo journalists. Despite the pressure, the weekly persists in writing the truth and defending freedom of expression.

Starting a magazine is as haphazard and uncertain a business as starting a book-who knows what combination of external events and subjective ideas has triggered the mind to move in a particular direction? And who knows, when starting, whether the thing will work or not and what relation the finished object will bear to one’s initial concept? That, at least, was my experience with Index, which seemed almost to invent itself at the time and was certainly not ‘planned’ in any rational way. Yet looking back, it is easy enough to trace the various influences that brought it into existence.

It all began in January 1968 when Pavel Litvinov, grandson of the former Soviet Foreign Minister, Maxim Litvinov, and his Englis wife, Ivy, and Larisa Bogoraz, the former wife of the writer, Yuli Daniel, addressed an appeal to world public opinion to condemn the rigged trial of two young writers and their typists on charges of ‘anti-Soviet agitation and propaganda’ (one of the writers, Alexander Ginzburg, was released from the camps in 1979 and now lives in Paris: the other, Yuri Galanskov, died in a camp in 1972). The appeal was published in The Times on 13 January 1968 and evoked an answering telegram of support and sympathy from sixteen English and American luminaries, including W H Auden, A J Ayer, Maurice Bowra, Julian Huxley, Mary McCarthy, Bertrand Russell and Igor Stravinsky.

The telegram had been organised and dispatched by Stephen Spender and was answered, after taking eight months to reach its addressees, by a further letter from Litvinov, who said in part: ‘You write that you are ready to help us “by any method open to you”. We immediately accepted this not as a purely rhetorical phrase, but as a genuine wish to help….’ And went on to indicate the kind oh help he had in mind:

My friends and I think it would be very important to create an international committee or council that would make it its purpose to support the democratic movement in the USSR. This committee could be composed of universally respected progressive writers, scholars, artists and public personalities from England, the United States, France, Germany and other western countries, and also from Latin America, Asia, Africa and, in the future, even from Eastern Europe…. Of course, this committee should not have an anti-communist or anti-Soviet character. It would even be good if it contained people persecuted in their own countries for pro-communist or independent views…. The point is not that this or that ideology is not correct, but that it must not use force to demonstrate its correctness.

Stephen Spender took up this idea first with Stuart Hampshire (the Oxford philosopher), a co-signatory of the telegram, and with David Astor (then editor of the Observer), who joined them in setting up a committee along the lines suggested by Litvinov (among its other members were Louis Blom-Cooper, Edward Crankshaw, Lord Gardiner, Elizabeth Longford and Sir Roland Penrose, and its patrons included Dame Peggy Ashcroft, Sir Peter Medawar, Henry Moore, Iris Murdoch, Sir Michael Tippett and Angus Wilson). It was not, admittedly, as international as Litvinov had suggested, but it was thought more practical to begin locally, so to speak, and to see whether or not there was something in it before expanding further. Nevertheless, the chosen name for the new organisation, Writers and Scholars International, was an earnest of its intentions, while its deliberate echo of Amnesty International (then relatively modest in size) indicated a feeling that not only literature but also human rights would be at issue.

By now it was 1971 and in the spring of that year the committee advertised for a director, held a series of interviews and offered me the job. There was no programme, other than Litvinov’s letter, there were no premises or staff, and there was very little money, but there were high hopes and enthusiasm.

It was at this point that some of the subjective factors I mentioned earlier began to come into play. Litvinov’s letter had indicated two possible forms of action. One was the launching of protests to ‘support and defend’ people who were being persecuted for their civic and literary activities in the USSR. The other was to ‘provide information to world public opinion’ about this state of affairs and to operate with ‘some sort of publishing house’. The temptation was to go for the first, particularly since Amnesty was setting such a powerful example, but precisely because Amnesty (and the International PEN Club) were doing such a good job already, I felt that the second option would be the more original and interesting to try. Furthermore, I knew that two of our most active members, Stephen Spender and Stuart Hampshire, on the rebound from Encounter after disclosures of CIA funding, had attempted unsuccessfully to start a new magazine, and I felt that they would support something in the publishing line. And finally, my own interests lay mainly in that direction. My experience had been in teaching, writing, translating and broadcasting. Psychologically I was too much of a shrinking violet to enjoy kicking up a fuss in public. I preferred argument and debate to categorical statements and protest, the printed page to the soapbox; I needed to know much more about censorship and human rights before having strong views of my own.

At that stage I was thinking in terms of trying to start some sort of alternative or ‘underground’ (as the term was misleadingly used) newspaper – Oz and the International Times were setting the pace were setting the pace in those days, with Time Out just in its infancy. But a series of happy accidents began to put other sorts of material into my hands. I had been working recently on Solzhenitzin and suddenly acquired a tape-recording with some unpublished poems in prose on it. On a visit to Yugoslavia, I called on Milovan Djilas and was unexpectedly offered some of his short stories. A Portuguese writer living in London, Jose Cardoso Pires, had just written a first-rate essay on censorship that fell into my hands. My friend, Daniel Weissbort, editor of Modern Poetry in Translation, was working on some fine lyrical poems by the Soviet poet, Natalya Gorbanevskaya, then in a mental hospital. And above all I stumbled across the magnificent ‘Letter to Europeans’ by the Greek law professor, George Mangakis, written in one of the colonels’ jails (which I still consider to be one of the best things I have ever published). It was clear that these things wouldn’t fit very easily into an Oz or International Times, yet it was even clearer that they reflected my true tastes and were the kind of writing, for better or worse, that aroused my enthusiasm. At the same time I discovered that from the point of view of production and editorial expenses, it would be far easier to produce a magazine appearing at infrequent intervals, albeit a fat one, than to produce even the same amount of material in weekly or fortnightly instalments in the form of a newspaper. And I also discovered, as Anthony Howard put it in an article about the New Statesman, that whereas opinions come cheap, facts come dear, and facts were essential in an explosive field like human rights. Somewhat thankfully, therefore, my one assistant and I settled for a quarterly magazine.

There is no point, I think, in detailing our sometimes farcical discussions of a possible title. We settled on Index (my suggestion) for what seemed like several good reasons: it was short; it recalled the Catholic Index Librorum Prohibitorum; it was to be an index of violations of intellectual freedom; and lastly, so help me an index finger pointing accusingly at the guilty oppressors – we even introduced a graphic of a pointing finger into our early issues. Alas, when we printed our first covers bearing the bold name of Index (vertically to attract attention nobody got the point (pun unintended). Panicking, we hastily added the ‘on censorship’ as a subtitle – Censorship had been the title of an earlier magazine, by then defunct – and this it has remained ever since, nagging me with its ungrammatically (index of censorship, surely) and a standing apology for the opacity of its title. I have since come to the conclusion that it is a thoroughly bad title – Americans, in particular, invariably associate it with the cost of living and librarians with, well indexes. But it is too late to change now.

Our first issue duly appeared in May 1972, with a programmatic article by Stephen Spender (printed also in the TLS) and some cautious ‘Notes’ by myself. Stephen summarised some of the events leading up to the foundation of the magazine (not naming Litvinov, who was then in exile in Siberia) and took freedom and tyranny as his theme:

Obviously there is a risk of a magazine of this kind becoming a bulletin of frustration. However, the material by writers which is censored in Eastern Europe, Greece, South Africa and other countries is among the most exciting that is being written today. Moreover, the question of censorship has become a matter of impassioned debate; and it is one which does not only concern totalitarian societies.

I contented myself with explaining why there would be no formal programme and emphasised that we would be feeling our way step by step. ‘We are naturally of the opinion that a definite need {for us} exists….But only time can tell whether the need is temporary or permanent—and whether or not we shall be capable of satisfying it. Meanwhile our aims and intentions are best judged…by our contents, rather than by editorials.’

In the course of the next few years it became clear that the need for such a magazine was, if anything, greater than I had foreseen. The censorship, banning and exile of writers and journalists (not to speak of imprisonment, torture and murder) had become commonplace, and it seemed at times that if we hadn’t started Index, someone else would have, or at least something like it. And once the demand for censored literature and information about censorship was made explicit, the supply turned out to be copious and inexhaustible.

One result of being inundated with so much material was that I quickly learned the geography of censorship. Of course, in the years since Index began, there have been many changes. Greece, Spain, and Portugal are no longer the dictatorships they were then. There have been major upheavals in Poland, Turkey, Iran, the Lebanon, Pakistan, Nigeria, Ghana and Zimbabwe. Vietnam, Cambodia and Afghanistan have been silenced, whereas Chinese writers have begun to find their voices again. In Latin America, Brazil has attained a measure of freedom, but the southern cone countries of Chile, Argentina, Uruguay and Bolivia have improved only marginally and Central America has been plunged into bloodshed and violence.

Despite the changes, however, it became possible to discern enduring patterns. The Soviet empire, for instance, continued to maltreat its writers throughout the period of my editorship. Not only was the censorship there highly organised and rigidly enforced, but writers were arrested, tried and sent to jail or labour camps with monotonous regularity. At the same time, many of the better ones, starting with Solzhenitsyn, were forced or pushed into exile, so that the roll-call of Russian writers outside the Soviet Union (Solzhenitsyn, Sinyavksy, Brodsky, Zinoviev, Maximov, Voinovich, Aksyonov, to name but a few) now more than rivals, in talent and achievement, those left at home. Moreover, a whole array of literary magazines, newspapers and publishing houses has come into existence abroad to serve them and their readers.

In another main black spot, Latin America, the censorship tended to be somewhat looser and ill-defined, though backed by a campaign of physical violence and terror that had no parallel anywhere else. Perhaps the worst were Argentina and Uruguay, where dozens of writers were arrested and ill-treated or simply disappeared without trace. Chile, despite its notoriety, had a marginally better record with writers, as did Brazil, though the latter had been very bad during the early years of Index.

In other parts of the world, the picture naturally varies. In Africa, dissident writers are often helped by being part of an Anglophone or Francophone culture. Thus Wole Soyinka was able to leave Nigeria for England, Kofi Awoonor to go from Ghana to the United States (though both were temporarily jailed on their return), and French-speaking Camara Laye to move from Guinea to neighbouring Senegal. But the situation can be more complicated when African writers turn to the vernacular. Ngugi wa Thiong’o, who has written some impressive novels in English, was jailed in Kenya only after he had written and produced a play in his native Gikuyu.

In Asia the options also tend to be restricted. A mainland Chinese writer might take refuge in Hong Kong or Taiwan, but where is a Taiwanese to go? In Vietnam, Cambodia, Laos, the possibilities for exile are strictly limited, though many have gone to the former colonising country, France, which they still regard as a spiritual home, and others to the USA. Similarly, Indonesian writers still tend to turn to Holland, Malaysians to Britain, and Filipinos to the USA.

In documenting these changes and movements, Index was able to play its small part. It was one of the very first magazines to denounce the Shah’s Iran, publishing as early as 1974 an article by Sadeq Qotbzadeh, later to become Foreign Minister in Ayatollah Khomeini’s first administration. In 1976 we publicised the case of the tortured Iranian poet, Reza Baraheni, whose testimony subsequently appeared on the op-ed page of the New York Times. (Reza Baraheni was arrested, together with many other writers, by the Khomeini regime on 19 October 1981.) One year later, Index became the publisher of the unofficial and banned Polish journal, Zapis, mouthpiece of the writers and intellectuals who paved the way for the present liberalisation in Poland. And not long after that it started putting out the Czech unofficial journal, Spektrum, with a similar intellectual programme. We also published the distinguished Nicaraguan poet, Ernesto Cardenal, before he became Minister of Education in the revolutionary government, and the South Korean poet, Kim Chi-ha, before he became an international cause célèbre.

One of the bonuses of doing this type of work has been the contact, and in some cases friendship, established with outstanding writers who have been in trouble: Solzhenitsyn, Djilas, Havel, Baranczak, Soyinka, Galeano, Onetti, and with the many distinguished writers from other parts of the world who have gone out of their way to help: Heinrich Böll, Mario Vargas Llosa, Stephen Spender, Tom Stoppard, Philip Roth—and many other too numerous to mention. There is a kind of global consciousness coming into existence, which Index has helped to foster and which is especially noticeable among writers. Fewer and fewer are prepared to stand aside and remain silent while their fellows are persecuted. If they have taught us nothing else, the Holocaust and the Gulag have rubbed in the fact that silence can also be a crime.

The chief beneficiaries of this new awareness have not been just the celebrated victims mentioned above. There is, after all, an aristocracy of talent that somehow succeeds in jumping all the barriers. More difficult to help, because unassisted by fame, are writers perhaps of the second or third rank, or young writers still on their way up. It is precisely here that Index has been at its best.

Such writers are customarily picked on, since governments dislike the opprobrium that attends the persecution of famous names, yet even this is growing more difficult for them. As the Lithuanian theatre director, Jonas Jurasas, once wrote to me after the publication of his open letter in Index, such publicity ‘deprives the oppressors of free thought of the opportunity of settling accounts with dissenters in secret’ and ‘bears witness to the solidarity of artists throughout the world’.

Looking back, not only over the years since Index was started, but much further, over the history of our civilisation, one cannot help but realise that censorship is by no means a recent phenomenon. On the contrary, literature and censorship have been inseparable pretty well since earliest times. Plato was the first prominent thinker to make out a respectable case for it, recommending that undesirable poets be turned away from the city gates, and we may suppose that the minstrels and minnesingers of yore stood to be driven from the castle if their songs displeased their masters. The examples of Ovid and Dante remind us that another old way of dealing with bad news was exile: if you didn’t wish to stop the poet’s mouth or cover your ears, the simplest solution was to place the source out of hearing. Later came the Inquisition, after which imprisonment, torture and execution became almost an occupational hazard for writers, and it is only in comparatively recent times—since the eighteenth century—that scribblers have fought back and demanded an unconditional right to say what they please. Needless to say, their demands have rarely and in few places been met, but their rebellion has resulted in a new psychological relationship between rulers and ruled.

Index, of course, ranged itself from the very first on the side of the scribblers, seeking at all times to defend their rights and their interests. And I would like to think that its struggles and campaigns have borne some fruit. But this is something that can never be proved or disproved, and perhaps it is as well, for complacency and self-congratulation are the last things required of a journal on human rights. The time when the gates of Plato’s city will be open to all is still a long way off. There are certainly many struggles and defeats still to come—as well, I hope, as occasional victories. When I look at the fragility of Index‘s a financial situation and the tiny resources at its disposal I feel surprised that it has managed to hold out for so long. No one quite expected it when it started. But when I look at the strength and ambitiousness of the forces ranged against it, I am more than ever convinced that we were right to begin Index in the first place, and that the need for it is as strong as ever. The next ten years, I feel, will prove even more eventful than the ten that have gone before.
