Anniversaries and commemorations are times to reflect, judge and move forward. So it is with World Press Freedom Day, which we note for the 22nd time this year amid worldwide evidence of hostility toward the media.
The date of 3 May was set aside by the UN General Assembly in 1993 to foster free, independent, pluralistic media worldwide.
The Organization for Security and Co-operation in Europe, the largest regional security organisation in the world, just four years later in 1997 created the position I now hold, the Representative on Freedom of the Media. The position was established expressly to help countries that are members of the organisation (which includes all of Europe, the countries of the former Soviet Union and Mongolia, as well as the United States and Canada) implement their promises to uphold the rights to free expression and free media.
It is my job to advocate for these two concepts. It is also my job to help, cajole and sometimes plead with the 57 nations in the organisation to simply live up to their promises to provide the environment in which free expression and free media can flourish.
Over the past 18 years only three people have held the position of Representative. As I enter my sixth and last year in this position, the time has come to reflect on the state of media freedom and to analyse the overall health of free expression across the OSCE region.
To do so, I needed a base from which to judge. I found that by returning to the very first public statement issued by the Representative’s office, then headed by German politician Freimut Duve, on 7 September 1998. It announced, ironically, that Duve had been denied a visa by authorities in Belgrade to visit the Federal Republic of Yugoslavia, to lobby the government to change its policy of denying visas to reporters from other countries, some of whom were considered foreign intelligence agents.
The Helsinki Final Act of 1975, the very document that eventually brought the OSCE into existence, expressly called for improving the working conditions for journalists, which included examining “in a favorable spirit and within a suitable and reasonable time scale requests from journalists for visas” and to “grant to permanently accredited journalists…on the basis of arrangements, multiple entry and exit visas for specified periods”.
Duve wrote in the public statement: “Tito himself, as President of the former Yugoslavia, signed in 1975 his country’s acceptance of the principles and commitments of the Conference for Security and Cooperation in Europe.”
Those commitments expressly included the right of journalists to work internationally.
Promises made. Promises not kept.
Have things changed over the years?
The fact that you are reading this posting identifies you as someone well aware of the precarious position journalists and the media find themselves in today. They face a litany of problems, none of which is bigger than the issue of life itself.
The year 2015 hardly had started when eight journalists for the French magazine Charlie Hebdo were murdered in their office in Paris – over the depiction of a religious figure. Two weeks later, a discussion group in Copenhagen convened to talk about the Paris incident came under gunfire with another person killed. So much for free media. So much for free expression.
But we all know that while homicidal violence against journalists is the most drastic form of attack on free media, it is not the only one. Across the OSCE region media is subject to all nature of offences: criminal defamation laws that put reporters in jail for rooting out corruption in public places; cyber-attacks that plague internet media sites; new laws that are being adopted to criminalise free expression in the name of fighting terrorism; and increasing regulation of the internet in an effort by authoritarian governments to squelch media and free expression advocates.
The simple violations of media rights continue, too. In the past 12 months I have written to authorities and issued public statement on at least six occasions condemning the refusal of governments in the OSCE region to grant visas to foreign-based reporters. Have things really changed in 2015 from 1998? Only the countries involved; not the practices.
But even if my judgment on the past 18 years is harsh, media freedom advocates, such as me, must continue to move forward and provide the defenses necessary for free expression and free media to flourish. Complacency is not an option.
Solidarity, however, is.
For example, three rapporteurs on free expression from the United Nations, the Organization of American States and the African Commission on Human and People’s Rights and I annually issue a joint declaration on a topic related to free expression. Those declarations now are seeing their way into decisions of national and international bodies, including judgments of the European Court of Human Rights. This is real progress. Decisions upholding citizens’ rights under Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms are real results.
And all of us must continue to raise the issue of the rights of media before national legislatures. Public awareness campaigns on behalf of media can be effective tools to prod elected officials to spend the resources, including political capital, necessary to build environments conducive to free expression. Elected officials and their appointed, often nameless and faceless bureaucrats, can be taught and encouraged to write good laws and appoint good law enforcement authorities, including police, prosecutors and judges, to interpret those laws in a fashion that will provide oxygen for those who champion free expression.
It is easy to become disillusioned and depressed by the daily fare of media issues. We should recognise the perilous state of free media and free expression in many spots in the world. But we never should lose our focus. We should take note of this date and make a personal commitment to stand for the basic human rights of free expression and free media – this year and the next and the years after that.

In my column in the latest issue of Index magazine, re-published below, I explored the shrinking space for free expression on university campuses. It’s getting worse. Earlier this week, we learned Queen’s University in Belfast had cancelled a conference on the fallout from the Charlie Hebdo attack, citing security fears. That followed a decision by the University of Southampton to axe a conference on Israel after pressure from the Zionist Federation UK. Another group is now pressurising respected medical journal The Lancet over its coverage of Palestine.
Index condemns these attempts to stifle free and open debate. It is clear that academic freedom is under threat from special interest groups who believe that no one should be exposed to ideas that they find personally offensive. The result is that the universe of ideas and opinions is shrivelling. We need to push back, and universities, students, academics and academic publications must resist this pressure.
Something is going wrong at universities. Institutions that should be crucibles for new thinking, at the forefront of challenges to established thought and practice, are instead actively shutting down debate, and shying away from intellectual confrontation.
Driven by the notion that students should not be exposed to ideas they find – or might find – offensive or troubling, student groups and authorities are increasingly squeezing out free speech – by banning controversial speakers, denying individuals or groups platforms to speak, and eliminating the possibility of “accidental” exposure to new ideas through devices such as trigger warnings.
The trend was particularly noticeable last year when a number of invited speakers withdrew from university engagements – or had their invitations rescinded – following protests from students and faculty members. Former US Secretary of State Condoleezza Rice withdrew from a planned address at Rutgers University in New Jersey after opposition from those who cited her involvement in the Iraq war and the Bush administration’s torture of terrorism suspects; Brandeis University in Massachusetts cancelled plans to award an honorary degree to Islam critic Ayaan Hirsi Ali; and Christine Lagarde backed out of a speech at Smith College following objections by students over the acts of the International Monetary Fund, which Lagarde runs. In the UK, the University of East London banned an Islamic preacher for his views on homosexuality. And a new law – a counter-terrorism bill – was proposed in Britain that could be used to force universities to ban speakers considered “extremist”.
Registering your objection to something or someone is one thing. Indeed, the ability to do that is fundamental to free expression. Actively seeking to prevent that person from speaking or being heard is quite another. It is a trend increasingly visible in social media – and its appearance within universities is deeply troubling.
It is seen not just in the way invited speakers are treated, but it stretches to the academic fraternity itself. Last year, the University of Illinois at Urbana-Champaign withdrew a job offer to academic Steven Salaita following critical posts he made on Twitter about Israel.
In an open letter, Phyllis Wise, University of Illinois at Urbana-Champaign chancellor, in an open letter, wrote: “A pre-eminent university must always be a home for difficult discussions and for the teaching of diverse ideas… What we cannot and will not tolerate at the University of Illinois are personal and disrespectful words or actions that demean and abuse either viewpoints themselves or those who express them. We have a particular duty to our students to ensure that they live in a community of scholarship that challenges their assumptions about the world but that also respects their rights as individuals.”
These incidents matter because, as education lecturer Joanna Williams wrote in The Telegraph newspaper: “If academic freedom is to be in anyway meaningful it must be about far more than the liberty to be surrounded by an inoffensive and bland consensus. Suppressing rather than confronting controversial arguments prevents criticality and the advance of knowledge, surely the antithesis of what a university should be about?”
Yet, increasingly, universities seem to want to shut down controversy, sheltering behind the dangerous notion that protecting people from anything but the blandest and least contentious ideas is the means to keep them “safe”, rather than encouraging students to have a wide base of knowledge. In the US, some universities are considering advising students that they don’t have to read material they may find upsetting, and if they don’t their course mark would not suffer, according to the Los Angeles Times.
In the UK, increasing intolerance for free expression is manifest in the “no platform” movement – which no longer targets speakers or groups that incite violence against others, but a whole host of individuals and organisations that other groups simply find distasteful, or in some way disqualified from speaking on other grounds.
The decision to cancel an abortion debate at Oxford in late 2014, which would have been held between two men – and noted free speech advocates – came after a slew of objections, including a statement from the students’ union that decried the organisers for having the temerity to invite people without uteruses to discuss the issue.
Encountering views that make us feel uncomfortable, that challenge our worldview are fundamental to a free society. Universities are places where that encounter should be encouraged and celebrated. They should not be places where ideas are wrapped in cotton wool, where academic freedom comes to mean having a single kind of approved thinking, or where only certain “approved” individuals are allowed to speak on a given topic.
Index on Censorship knows well the importance of the scholar in freedom of expression. Though we have come to be known as Index, the charity itself is officially called Writers and Scholars International, an effort to capture as simply as possible the individuals whom we intended to support from the outset. The title was never intended to be exclusive, but the inclusion of “scholar” signals the importance our founders attached to the role of the academic as a defender and promoter of free speech. In 2015, as we watch the spaces for free expression narrow, we will work doubly hard to ensure that university remains an arena for the clash of ideas, not the closure of minds.

A Kenyan woman speaking out for women in one of the world’s most dangerous regions and a female journalist who exposed an unreported uprising in Saudi Arabia are among the winners of this year’s Index on Censorship Freedom of Expression Awards.
“Our shortlisted nominees are all tackling direct and serious threats to stifle free speech,” said Index on Censorship CEO Jodie Ginsberg. “We were humbled and inspired by their stories, and their dedication to ensuring we can all speak freely.”

Awards are presented in four categories: journalism, arts, campaigning and digital activism. The winners were Saudi journalist Safa Al Ahmad and Angolan reporter Rafael Marques de Morais (journalism – jointly awarded); Moroccan rapper “El Haqed” (arts); Kenyan women’s rights campaigner Amran Abdundi (campaigning); and Hungarian freedom of information website Atlatszo (digital activism).

Al Ahmad was recognised for her documentary Saudi’s Secret Uprising, which exposed details of an unreported mass demonstration in Saudi Arabia. “Safa Al Ahmad dared to go into places that are difficult for women and for reporters, to bring that information back and share it with the world,” said Turkish author Elif Shafak, one of the five judges. Saudi Arabia is a mystery, even to its own people, said Al Ahmad in her acceptance speech: “Parts of our history is deliberately concealed, the present is muddled with rumours and half-truths. The government-owned and controlled media play a major role in the dissemination of those false realities of ourselves and others. This makes facts a precious commodity in Saudi Arabia.”
Angolan investigative reporter Marques de Morais has been repeatedly prosecuted for his work exposing government and industry corruption and will go on trial on 24 March charged with defamation. “Rafael is a very important individual doing very important work in a very, very difficult environment,” said judge Sir Keir Starmer QC. Marques de Morais dedicated his speech to the Zone 9 group of Ethiopian bloggers currently in jail “for the crime of exercising their right to freedom of expression”.

The winner in the campaigning category, Amran Abdundi, is a women’s rights activist based in north-eastern Kenya and runs a group helping women along the dangerous border with Somalia, where terrorism and extremist violence dominate. Judge Martha Lane Fox said: “Amran Abdundi was a standout candidate for me. She is doing something incredibly powerful in an unbelievably complicated and dangerous situation.” Abdundi dedicated her award to the “marginalised women of northern Kenya… who will now know that their struggles and their efforts to fight for their rights are being recognised internationally”.
Help us let the world know the truth

Arts category winner Mouad “El Haqed” Belghouat is a Moroccan rapper and human rights activist whose music highlights widespread poverty and endemic government corruption in Morocco. He has been imprisoned on spurious charges three times in as many years, most recently in 2014. Belghouat said in his acceptance speech: “I have been through difficult times: I was jailed, fired from my work, rejected by many friends. I am still forbidden to sing in my own country. But after all that I am still determined that I will never change my position. I will fight for freedom, equality and human rights for ever.” Lane Fox said Belghouat had taken his music and “translated it into a kind of online activism, but then, crucially, mobilised people in the street”.
The digital award, decided by public vote, went to Hungarian investigative news outlet Atlatszo.hu managed by Tamás Bodoky. The website acts as watchdog to a Hungarian government which has increasingly tightened its grip on press freedom in the country. Editor-in-chief Bodoky said Atlatszo.hu called on all those who believe that independent journalism in Hungary is under threat. “All those who agree that politics and business interests have sunk their claws into everyday life. All those who know that taxpayer money is vanishing. We are calling on you to help us let the world know the truth.”

The awards were presented by the judges along with special guests including Guardian editor Alan Rusbridger.
A special award was also given on the evening to honour the many Azerbaijani journalists and activists jailed or forced into exile or hiding following a recent crackdown by the government. Former award winner and journalist Idrak Abbasov, who was forced to flee Azerbaijan last year, accepted the award on behalf of all those facing persecution in the country. “I call upon the world community to help Azerbaijan… so that our colleagues might be released and that our country might become a normal state in which we and others might live freely,” Abbasov told the audience in a video speech.
The evening featured an exhibition of specially commissioned cartoons by international cartoonists, reflecting on the past 12 months for free expression. Most of the artists had direct experience of persecution over their work, including Syrian political cartoonist Ali Ferzat – a former Index award winner – and Malaysia’s Zunar. “In the wake of the attacks on Charlie Hebdo, we wanted to pay homage to the work of cartoonists who are so often the first to face censorship in any move to stifle free expression,” said Index’s Jodie Ginsberg.
The attacks on French satirical magazine Charlie Hebdo in January threw a global spotlight on the challenges faced by cartoonists worldwide. Index has since its earliest days reported on the persecution of satirists. As part of our work in celebrating as well as defending free expression, Index has this year asked cartoonists to reflect on the past year for free expression in their own way.
