Bahraini Injustice: Nabeel Rajab subjected to humiliating treatment

[vc_row][vc_column][vc_single_image image=”91128″ img_size=”full” alignment=”center”][vc_column_text]Bahraini authorities yesterday transferred human rights defender Nabeel Rajab from a clinic to the notorious Jau Prison despite severe medical risks, subjecting him to humiliating treatment on arrival.

Prison officials have imprisoned Rajab in the very same cell in which he spent his previous two-year sentence. On arrival in Jau Prison, guards immediately searched him in a humiliating manner and shaved his hair by force. They further punished him by confiscating his books and clothes. Last night, guards raided his cell and began shouting; the prison officials also repeated their search of him in the middle of the night, in an apparent move to punish and humiliate the human rights defender.

One of Rajab’s charges is that he spoke out about the degrading treatment in Jau Prison, which he now endures himself. Yet Rajab is isolated from other prisoners convicted for speech-related crimes; he is instead detained in a cell with people convicted of being transgender, which is considered a criminal offence in Bahrain.

Yesterday Rajab’s wife had a call from Bahrain’s Criminal Investigative Directorate (CID) to tell her that her husband was to be transferred and she needed to collect his belongings, as he would no longer require them. This is the second week that prison officials have cancelled family visits with no explanation.

In early April 2017, Rajab was admitted to the Bahrain Defence Force hospital for vital surgery. He was transferred back to police custody just a day later, before having recovered from his operation, and his health deteriorated significantly. From there he was transferred to the Ministry of Interior Clinic (Al-Qalaa).

The previous month, in March 2017, Mohammad Sahwan died of sudden cardiac arrest in Jau Prison, the country’s largest long-term male detention facility. Sahwan was a victim of excessive use of force by police in 2012, and was the first political detainee to die in Jau Prison since 2011.

In early 2017, the Government of Bahrain intensified restrictions on inmates at Jau Prison, particularly targeting political prisoners and prisoners of conscience for increased abuse. Prison officials subjected the remaining eleven members of the “Bahrain 13” to severe deprivation of medical care.

Nabeel Rajab’s Charges

Rajab is currently serving a two-year prison sentence, after having been sentenced in absentia on 12 July to two years in prison on charges of “spreading false news” under article 134 of Bahrain’s Penal Code. His appeal began in September, but was this week postponed to 8 November for final arguments.

Rajab has been detained since his arrest on 13 June 2016. He was held largely in solitary confinement in the first nine months of his detention, violating the UN Standard Minimum Rules for Non-Custodial Measures (Tokyo Rules) which state: “pre-trial detention shall be used as a means of last resort in criminal proceedings, with due regard for the investigation of the alleged offence and for the protection of society and the victim.”

Rajab faces a concurrent trial in which he faces up to 15 years in prison on charges related to his tweets exposing torture in a Bahraini prison and criticising the humanitarian cost of the war in Yemen. In September 2017, a new set of charges were brought against Rajab related to social media posts made in January 2017, when he was already in detention and without internet access. Rajab also faces a fourth set of charges related to a letter he penned to the New York Times in September 2016. Targeting journalists in the name of national security

Last week, a reporter for the Wall Street Journal was convicted of producing “terrorist propaganda” in Turkey and sentenced to more than two years in prison.

Ayla Albayrak was charged over an August 2015 article in the newspaper, which detailed government efforts to quell unrest among the nation’s Kurdish separatists, “firing tear gas and live rounds in a bid to reassert control of several neighborhoods”.

Albayrak was in New York at the time the ruling was announced and was sentenced in absentia but her conviction forms part of a growing pattern of arrests, detentions, trials and convictions for journalists under national security laws – not just in Turkey, the world’s top jailer of journalists, but globally.

As security – rather than the protection of fundamental rights and freedoms – becomes the number one priority of governments worldwide, broadly-written security laws have been twisted to silence journalists.

It’s seen starkly in the data Index on Censorship records for a project monitoring media freedom in Europe: type the word “terror” into the search box of Mapping Media Freedom and more than 200 cases appear related to journalists targeted for their work under terror laws.

This includes everything from alleged public order offences in Catalonia to the “harming of national interests in Ukraine” to the hundreds of journalists jailed in Turkey following the failed coup.

This abusive phenomenon started small, as in the case of Turkey, with dismissive official rhetoric that was aimed at small segments — like Kurdish journalists — among the country’s press corps, but over time it expanded to extinguish whole newspapers or television networks that espouse critical viewpoints on government policy.

While Turkey has been an especially egregious example of the cynical and political exploitation of terror offenses, the trend toward criminalisation of journalism that makes governments uncomfortable is spreading.

In Spain, the Spanish police association filed a lawsuit against Mónica Terribas, a journalist for Catalunya Rádio, accusing her of “favouring actions against public order for calling on citizens in the Catalonia region to report on police movements during the referendum on independence.

The association said information on police movements could help terrorists, drug dealers and other criminals.

Undermining state security is a growing refrain among countries seeking to clamp down on a disobedient media, particularly in countries like Russia. In December 2016, State Duma Deputy Vitaly Milonov urged Russia’s Prosecutor General to investigate independent Latvia-based media outlet Meduza’s on charges of “promoting extremism and terrorism” for an article published the day before.

The piece written by Ilya Azar entitled, When You Return, We Will Kill You, documents Chechens who are leaving continental Europe through Belarussian-Polish border and living in a rail station in Brest, a border city in Belarus. Deputy Milonov said he considers the article a provocation aimed at undermining unity of Russia and praising terrorists.

In Turkey, reporting deemed critical of the government, the president or their associates is being equated with terrorism as seen in the case of German journalist Deniz Yucel who was detained in February this year.

Yucel, a dual Turkish-German national was working as a correspondent for the German newspaper Die Welt. He was arrested on charges of propaganda in support of a terrorist organization as well as inciting violence to the public and is currently awaiting trial, something that could take up to five years.

Outside of the European region, journalists regularly fall foul of national security laws. In April, journalist Ahmed Abba was sentenced to 10 years behind bars by a military tribunal in Cameroon after being convicted of non-denunciation of terrorism and laundering of the proceeds of terrorist acts. Accompanying the decade-long sentence was a fine of over $90,000 dollars. Abba, a journalist for Radio France International, was detained in July of 2015.  He was tortured and held in solitary confinement for three months.

The military court allegedly possessed evidence against Abba, who was barred from speaking with the media during his trial, which they found on his computer. Among the alleged evidence was contact information between Abba and the Islamist terrorist group Boko Haram. Abba, who was in the area to report on the Boko Haram conflict, claimed he obtained the information that was discovered on his phone from various social media outlets with the intent of using them for his report.

Yemeni journalist Yahya Abduraqeeb Al-Jubaihi was sentenced to death earlier this month for allegedly serving as an undercover spy for Saudi Arabian coalition forces. Al-Jubaihi, who has worked as a journalist for various Yemeni and Saudi Arabian newspapers, has been held in a political prison camp ever since he was abducted from his home in September 2016.

Al-Jubaihi is the first journalist to be sentenced to death in Yemen following a trial that many activists believe was politically motivated because of Al-Jubaihi’s columns criticising Houthis.

Increasingly, governments are turning to Interpol to target journalists under terror laws. Turkey has filed an application to seek an Interpol arrest warrant for Can Dündar, demanding the journalist’s extradition. In September, Uzbek journalist Narzullo Okhunjonov was detained by authorities in Ukraine following an Interpol red notice.

Uzbek authorities have issued an international arrest warrant on fraud charges against Okhunjonov, who had been living in exile in Turkey since 2013 in order to avoid politically motivated persecution for his reporting.

And governments are also using terror laws to spy on journalists. In 2014, the UK police admitted it used powers under terror legislation to obtain the phone records of Tom Newton Dunn, editor of The Sun newspaper, to investigate the source of a leak in a political scandal. Police powers under the Regulation of Investigatory Powers Act, which circumvents another law that requires police to have approval from a judge to get disclosure of journalistic material.

Even jokes can land journalists in trouble under terror laws. Last year, French police searched the office of community Radio Canut in Lyon and seized the recording of a radio programme, after two presenters were accused of “incitement to terrorism”.

Presenters had been talking about the protests by police officers that had recently been taking place in France. One presenter said: “This is a call to people who people who killed themselves or are feeling suicidal and to all kamikazes” and to “blow themselves up in the middle of the crowd”.

One of the presenters was put under judicial supervision and was forbidden to host the radio programme until he appeared in court.

Radio Canut journalist Olivier Combi explained that the comment was ironic: “Obviously, Radio Canut is not calling for the murder of police officers, as it was sometimes said in the press”, he said. “Things have to be put back in context: the words in question are a 30 seconds joke-like exchange between two voluntary radio hosts…Nothing serious, but no media outlet took the trouble to call us, they all used the version of the police.”

Fighting back to protect sources

Two Russian journalists — Oleg Kashin and Alexander Plushev — are pushing back, Meduza reported. Kashin and Plushev filed the lawsuit challenging Russia’s Federal Security Service’s demands that instant messaging apps turn over encryption keys for users’ private communications, which is being driven by Russia’s anti-terror legislation. The court rejected the suit with the judge reportedly found that the government’s demands do not infringe on Plushev’s civil rights.

The journalists had contended that the FSB’s demand violated their right to confidential conversations with sources. Kashin said that in his work as a journalist he had come to rely on apps such as Telegram to conduct interviews with politicians.

Bahraini court delays hearing for Nabeel Rajab

[vc_row][vc_column][vc_single_image image=”95198″ img_size=”full” add_caption=”yes” alignment=”center”][vc_column_text]Bahrain’s Appeals Court convened in the second appeals hearing for Nabeel Rajab, who was sentenced to two years in July for speaking to journalists.

The Appeals Court heard a Ministry of Interior witness on 25 October. The proceedings were postponed to 8 November for the defence’s final arguments, according to a local pro-government paper. Rajab also faces a concurrent trial in which he faces up to 15 years in prison on charges related to his twitter profile. In all, Rajab faces up to 17 years in prison.

Sayed Ahmed Alwadaei, Director of Advocacy, Bahrain Institute for Rights and Democracy: “Nabeel Rajab’s sentence to two years is solely for speaking the truth and exposing the horrific violations in Bahrain. His imprisonment is a shameful evidence of Bahrain’s horrific human rights record and the UK’s shameful policy, which whitewashes the Al Khalifa monarchy’s brutality and intolerance.”

“The ongoing judicial harassment of Nabeel defies logic. This is a vindictive, punitive and politically-motivated process aimed at crushing a non-violent advocate of human rights for simply expressing his opinions on the state of Bahrain. We again call on the government of Bahrain to immediately and unconditionally release Nabeel. We urgently demand that the government of the UK raise the case with their counterparts,” Rachael Jolley, deputy CEO, Index on Censorship said.

The 2012 Index on Censorship Freedom of Expression Campaigning Award-winning Rajab is currently serving a two-year prison sentence. On 12 July, he was sentenced in absentia to two years in prison on charges of “spreading false news” under article 134 of Bahrain’s Penal Code. His appeal began in September.

The charges relate solely to TV interviews Rajab gave in 2014 and 2015. Without irony, prosecution papers from the criminal court proceedings, seen by BIRD, state that Rajab is being prosecuted for stating that the Bahraini government “derogates from freedom of opinion and of expression.” Bahrain’s prosecution has treated Rajab as a criminal for speech acts such as: “accusing the ruling system in the Kingdom of following a policy of repression” and of “arresting those opposed to the regime”; or alleging “the commission by responsible [government] bodies of crimes of killing and torture.” In the prosecution’s account Mr. Rajab has also made statements accusing the Bahraini government of “evasion of responsibility”; engaging in “sectarianism”; and “suppressing opposition and violating international agreements and covenants.”

The UK’s Middle East Minister Alistair Burt was , where he met with senior officials and expressed support for the government’s reform programme – a programme which only Bahrain and the UK claim exists. He said “The UK will continue to support Bahrain to deliver its ambitious reform initiatives, with a particular focus on rule of law and human rights.”

In the US, the Trump Administration this year removed Obama-era human Rights conditions on arms sales, one of which was the unconditional release of Rajab. In September, the Trump Administration approved the sale of F-16 jets worth $2.78 billion.

Jodie Ginsberg: Art and authoritarianism

Good afternoon and thank you to Griffith University for inviting me to speak on this important topic of art and authoritarianism. The video you have just seen was created more than 30 years ago for the organisation I run, Index on Censorship, a global non-profit that publishes work by and about censored writers and artists and campaigns on their behalf.

It is work that was begun during the Cold War, at a time when Soviet dissidents were unable to publish work challenging the communist regime, when books like George Orwell’s 1984 were banned, and works like Samuel Beckett’s Waiting for Godot outlawed. It was a time when the magazine that Index still produces 45 years later had to be smuggled into eastern Europe, where clandestine literature was swapped for goods unobtainable in the communist east — including bananas.

These days we don’t send people out armed with bananas in exchange for banned texts, but the fact that Index is still in business more than 25 years after the end of the Cold War is a sad reflection that censorship remains alive and well across the world.

If anything, we are seeing its rise: democratic spaces are shrinking and authoritarianism creeping back in places where we thought we had seen its end.  

This afternoon’s talk will give a brief overview — that I hope will give a provide a context for our subsequent discussion —  of the ways in which authoritarian regimes seek to stifle the arts, or use arts for their own ends, and the ways in which artists fight back.

But first I want to reflect on why the arts are important? Often in public discourse, the arts are considered an ‘add on’, a ‘frippery’, nice to have — but non essential to our basic existence. But I would contend that artistic expression is what defines us as human beings. That the ability to make music, to sing, to dance, to paint, to write, to talk — is fundamental to our humanity. And it is therefore fundamental that we protect it.

The fact that artistic expression plays such a powerful and important role in our existence is perhaps best seen in the seemingly disproportionate amount of time authoritarian regimes spend targeting it. If the spoken or written word, if performance, if the image were not important, if they did not have power, then dictators wouldn’t spend half so much time worrying about them.

Indeed, artists are often the canaries in the mine, a leading barometer of freedom in a country: poorly funded, rarely unionised, but with the ability to powerfully capture uncomfortable truths, artists are easy to target.

In a classic authoritarian regime, artists are most easily targeted by banning works or types of works and by arresting those groups and individuals who step out of line.

Ultimately, censorship doesn’t work. And that’s because of the very nature of artistic expression itself: that the more ways the censors try to find to shut down the ideas, the beliefs they don’t like, the more artists find creative ways to express those same ideas.

[/vc_column_text][/vc_column][/vc_row][vc_row][vc_column][vc_column_text]Moroccan musician Mouad Belaghouat, known as El Haqed, was arrested in 2011 and spent two years in prison for criticising the king. A former winner of the Index on Censorship Freedom of Expression Award for arts, El Haqed’s work highlights corruption and widespread poverty in the country.

Frequently, though, authoritarian regimes censor those artists who fall out of favour not through a direct link to their work but by indirect means. Arresting them, for example, on another pretext such as financial irregularities.

Think of Chinese artist Ai Wei Wei, arrested in 2011 while officials investigated allegations of “economic crimes”. Ai Wei Wei was then hit with a demand for nearly $2 million in alleged unpaid taxes and fines.

Three years later Ai Wei Wei’s work ‘Sunflower Seeds” was cut from an exhibition in honoring the 15th anniversary of the Chinese Contemporary Art Award of which he was a founding, three-time jurist. Museum also workers erased Ai’s name from the list of the award’s past winners and jury members. Erasure: censorship in action.

Explicit censorship like this continues to exist in many countries, with many still operating censorship boards to assess films, books and plays for cutting or banning. In Lebanon, for example, a censorship bureau still exists to which playwrights and others must submit works for approval before they can be shown. In 2013, writer Lucien Bourjeily decided to try to play the censors at their own game and submitted a play called ‘Will it Pass or Not’ that aimed to highlight the arbitrary nature of decisions taken by the bureau. Unsurprisingly, the play was banned. The censorship board’s General Mounir Akiki appeared on television to explain the ban, presenting evidence from four so-called “critics” who insisted the play had no artistic merit and therefore would not be passed. Index published an extract from the play a few months later.

At the time, Bourjeily wrote about the challenges of writing when “the censorship law in Lebanon is so vague and elusive”. Much successful censorship by authoritarian regimes relies not so much on what is explicitly banned but rather on an uncertainty as to what is permitted and what not. In such an environment, self-censorship thrives.

It is just such an environment that artists identify in contemporary Russia where laws — including those on obscenity and offence to religious feeling — are applied erratically, and where funding might be stopped — apparently arbitrarily — if an organisation fails to step in line with a current emphasis on family and religious values.

In this unpredictable environment, artists must think twice before braving the system. If you don’t know where the lines are, how do you know when you have crossed them? In this case, artists might choose to do nothing at all rather than breach an unstated limit.

The 2013 Russian law criminalising acts offending religious believers reflects a broader creep globally in which artists are punished by governments – or by non-state actors including the likes of ISIS – for offence. Bangladesh has seen a series of fatal attacks against writers, publishers and bloggers, many of whom have been targeted for their atheist views.

A failure by the government to get justice for these killings – or even publicly condemn them – is encouraging a state of impunity that encourages further attacks.

In fact, the Bangladesh government has actually placed the onus on writers to avoid writing anything “objectionable” about religion. Writers have been charged under a wide-ranging law used to prosecute anyone who publishes anything on or offline that hurts “religious sentiment” or prejudices the “image of the state.” Last year, during the country’s largest book fair writer Shamsuzzoha Manik was arrested for publishing a book called Islam Bitorko (Debate on Islam).

It is not just insulting religious sentiment that is increasingly problematic in the Muslim world. In countries like Poland, which is also experiencing its own form of creeping authoritarianism in common with many of its neighbours, the Catholic church is resuming an old role as censor in chief. State prosecutors there this year investigated the producers of a play that examines the relationship between the Polish Catholic church and the state, and castigates authorities for failing to respond to allegations of child abuse. In the play’s most notorious scene, an actor simulates oral sex on a plastic statue of the late Polish pope John Paul II, as a sign reads: “Defender of paedophiles”.

What starts as censorship of the arts quickly bleeds into other areas, like education.

In Bangladesh for example, the law I described earlier has been invoked against those who have questioned facts about the 1971 war.

Rewriting history is something authoritarian regimes are rather good at.

Earlier this year index published a story by award-winning author Jonathan Tel about an actor in a time travel TV show who gets stuck in 19th century Beijing after the government axes the genre. It’s a fictional take on true life: in 2011 the Chinese-government did ban all time-travel themed television.

The genre had become extremely popular and therefore hard to control, generating multiple narratives about the past. That posed a challenge for a Chinese Communist Party who only want a singular narrative, the one they control, that China was a country of corrupt feudal overlords and emperors until saved by the party in 1949.

When the ban came into place the administration said it was because the genre ‘disrespects history’.

This impulse to control the narrative is what drives propaganda. Traditionally, authoritarian regimes have found propaganda easiest to achieve simply by shutting down media outlets to limit the flows of information to a limited number of channels controlled by the government: a single newspaper, a government-controlled broadcaster and so on. With art, this is more challenging, and so the art produced by governments for propaganda often finds its expression in a cult of personality linked to a dictator — think of the Stalin statues that mushroomed during his time in office. In North Korea, the government commissions large scale art works depicting the people at work.

Art as defender — and threat to — the national image is inextricably linked, especially in modern regimes, with threats to national security. We see this clearly in countries like Turkey, a democracy that has rapidly slid back into authoritarianism over the past 18 months without passing ‘Go’. Authors, performers, artists have all found themselves at the sharp end of President Erdogan’s ire, and accused of terrorism simply for offering a critique of his government. Erdogan, in common with many dictators, appears to hate more than anything being laughed at and so cartoonists and satirists have found themselves targeted. Cartoonist Musa Kart was imprisoned for nearly 10 months and faces nearly 30 years in jail for his satirical cartoons of the President and his government. In Malaysia, cartoonist Zunar faces up to 43 years in jail for his cartoons lampooning the prime minister and his wife.

I talked at the start about a resurgence of authoritarianism. In conclusion, I want to talk about a feature of censorship that I think is remarkable and which, perhaps, dictators might like to reflect on. That, ultimately, censorship doesn’t work. And that’s because of the very nature of artistic expression itself: that the more ways the censors try to find to shut down the ideas, the beliefs they don’t like, the more artists find creative ways to express those same ideas. Burkina Faso artist Smockey, an outspoken critic of the government whose studios have been firebombed twice because of his work, continues to make music and describes it as the duty of the artists to resist. Yemeni graffiti artist Murad Subay paints public murals that highlight the atrocities being inflicted on his people – and encourages others, ordinary citizens, to join him. Others are more covert: the musicians who meet underground, or the filmmakers who use allegory and metaphor to flout literalist censors.

And perhaps that should give us cause for optimism — at the very least, optimism about the human spirit and its ability to challenge the greatest tyrants through the pen or the paintbrush. To quote Harry Lime in the wonderful film The Third Man: “Don’t be so gloomy. After all it’s not that awful. Like the fella says, in Italy for 30 years under the Borgias they had warfare, terror, murder, and bloodshed, but they produced Michelangelo, Leonardo da Vinci, and the Renaissance. In Switzerland they had brotherly love – they had 500 years of democracy and peace, and what did that produce?
