Francis Guy meets with Mohammed Hussein Fadlallah
LONDON (INDEX). — Outspoken and sometimes controversial, Frances Guy public profile rose when she was forced to apologise for lauding Lebanon’s Grand Ayatollah Mohammed Hussein Fadlallah after his death in 2010. The White House had branded the Shia cleric “a terrorist” and the Foreign Office said that Guy’s internet posting praising Fadlallah as a “true man of religion” had been removed “after mature consideration”.
Index on Censorship sat with her to discuss the dilemmas of public service and free speech, as well as her vast experience in the Middle East and the challenges women face in that region.
INDEX: You have spoken about the importance of a free press and have actively supported journalists who have been threatened or imprisoned by their governments. How do you see the state of the free press in the Middle East in 2012?
FRANCES GUY: I cannot speak for all of the region but generally this is a good moment for press freedom in the Middle East. In fact, the advent of satellite television had already made it hard for dictatorial regimes to suppress all alternative sources of information. Al Jazeera was a breath of fresh air, not only to those limited by CNN’s version of world news, but also to all those whose only news came from state controlled television, radio and newspapers. I understand the press in Tunisia is effervescent in its reaction to so many years of uniformity and I know that every night in Baghdad I have a choice of more than 20 Iraqi TV stations to choose from.
All is not perfect of course and the counter-balance to releasing the lid on heavily censored press is to ensure responsible reporting. In Lebanon reporting was not always reliable, so while the press is relatively free there is scope for improving the quality of reporting.
The crisis in Syria has thrown open a new debate on what is information and how you can guarantee its’ authenticity. When access to outside journalists is so severely limited, unbiased reporting is almost impossible. One side’s truth becomes the other side’s lies. Access to the internet makes everyone a potential reporter but verification becomes ever more important.
INDEX: During your postings as Her Majesty’s representative in Yemen and Lebanon, you spoke passionately on greater freedoms for women and lesbian, gay, bisexual, and transgender (LGBT) citizens in those countries and the region. What do you think governments in these countries could realistically do to increase freedoms for these groups?
FG: One of the issues that shapes public perception is image. There is a debate going on in Iraq at the moment instigated by the women’s journalists association about the image of women in the press; whether it is in Egyptian or Turkish soap operas, where the women are often second class citizens, the brunt of jokes, or reduced to playing supporting roles or whether it is about air time given to women politicians. If governments wanted to improve the status of marginalised groups in society they can ensure that their own spokespeople are from these marginalised groups. Governments can lead by example by nominating women to office where they will have constant media exposure.

Ending discriminatory laws would also help. Relatively simple acts like ensuring gender neutral language in the constitution can play a very important role. In Arabic nouns can be male or female. Some (men) argue that because common practice is that the plural male form in Arabic of e.g. the word citizens is assumed to include men and women then it is acceptable to have only the male form referred to in a constitution. But this leaves a legal ambiguity which can be exploited. It would be so easy to simply include the male and female forms in such texts or to make an explanatory note in every law explaining that the use of the masculine form is used in the sense of men and women on an equal basis without prejudice. I am not sure that any Arab state has done this.
Freedom of expression for LGBT citizens is regrettably even more problematic, but if governments could be persuaded to uphold the neutrality of rights enshrined in constitutions that would go a long way to ensuring those rights are truly applied to all.
INDEX: While you represented the British government, you blogged about matters of interest to you and to the British government. Over the past year, the media has questioned appropriateness of British foreign office representatives using social media as a tool of diplomacy. What are your thoughts?
FG: I think it might have been William Hague who said that there is an inherent contradiction between writing a readable/interesting blog and being a mouthpiece for government. I found it difficult to find something worth writing that did not betray confidences or risked upsetting someone. I therefore often wrote about subjects other than politics; the life cycle of the cedar tree, for example. But that is difficult to sustain.
I enjoyed blogging, and the experiment brought me into contact with groups I would never have met otherwise; bloggers in Lebanon who had been imprisoned for their views, for example. Who talks about them? And the LGBT community, similarly sidelined and oppressed. I think the bigger question is about transparency in government. If you believe that better government is open and transparent government then diplomats should be blogging.
INDEX: What limits on the freedom to express yourself did you encounter while you were an Ambassador?
PG: An Ambassador is always an ambassador 24 hours a day. You are judged as being Her Majesty’s Representative, not as an individual. Inevitably, there can be a tension between what you believe as an individual and what you are asked to say on behalf of your government. Even off the record you are an official representative. But that is part of the job and understood as such. If anything, the UN is often even more cautious, because it is formed of member states, i.e. governments so it is wary of criticising openly its members.
INDEX: You have spoken in the past about “freedom with responsibility”, could you elaborate?
PG: I am not sure of the context of the quote, but I am fairly sure that my intention would have been aimed at some irresponsible sections of the media, who do not verify information and who can (perhaps sometimes deliberately) put people’s lives in danger by stating unproven accusations as fact. Some Lebanese journalists are guilty of this, as indeed were many Ethiopians when I served there. The responsibility is to the truth but also to being conscious of the implications of printing/publicising some facts and not others. The British press is clearly not immune to a similar discussion — just because you can do something in the name of freedom of expression does not mean that you have to do it.
INDEX: Having served on the British government, you will be aware of accusations of hypocrisy when countries like the UK lecture other governments about their human rights records when the UK hasn’t “sorted out its own backyard”. What has been your reaction to these accusations?
FG: “Our own backyard” was less of a problem than our failure (as my interlocutors would see it) to deal with crimes that our politicians and armies had committed overseas. There were awkward moments though, when e.g. you are supporting quotas for women as a way to make progress in women’s representation in Parliament, when your own country under successive governments has not introduced quotas and has generally been wary of any kind of positive discrimination. My reaction though was always that freedom of expression, including in the ability to vote out your government if you disagree with it, guarantees a sound level of public debate about all issues.

INDEX: You have recently taken up your post with UN Women in Iraq. What freedom of expression issues have you encountered since you arrived?
FG: I have attended was about the image of women in the media and how that can cement social perceptions. The challenge is to get Iraqi TV to show different kinds of women, playing different roles on screen. I am impressed with some of the phone-in programmes on radio which allow citizens to voice their frustrations with the failure of the state to deliver public services. In itself they will not change very much but it does mean that no politician can pretend that they don’t know what the issues are. For a state that was famous for its tyranny of expression, it is refreshing to find people so willing to express their views publicly.
INDEX: What do you see as the key battle grounds for free expression in the next five years?
FG: Five years is a long time in today’s fast moving media scene. For the next months, I think the issue of so-called citizen’s journalists, and immediate access to YouTube etc, will continue to be paramount. What moral limits are there on what should be accessible? Who decides? Can governments’ prevent documents being uploaded on YouTube? Do YouTube, Google etc have some moral parameters – should executions be so readily accessible? And for women, the debate on images of women, including the increasing accessibility of pornographic images will also continue. I think I will put on my wall the pictures of women weight lifters at the Olympic Games… what power and majesty (and defiance).

There are clearly parallels between investigative journalists and artists who reveal uncomfortable truths. But when controversy breaks, artists are much more exposed because they use their own personal language to tell the story, and bring their own experience and imagination into the narrative.
To cater for their needs, Artsfex, the first international civil society network dedicated to promoting free expression for artists, has recently been created.
“When the international community places emphasis on the protection of freedom of speech, it generally focuses on the freedom of media and literature,” says Ole Reitov, Programme Manager at Freemuse and one of Artsfex’s promoters.
International human rights organisations include repression of media and media professionals in their annual and country reports on freedom of expression. However, they rarely document repression of artists or cultural workers.
Reitov adds:
But artistic expression is under pressure from many sides and it is frequently in the centre of conflicts between different interest groups. This is where Artsfex comes in. We hope to be able to not only document violations but support artists at risk.
Artsfex has been designed to join up pockets of campaigning that are often ignited in the wake of controversy, to amplify, reinforce and add weight to the artists’ voice when they stand up to authorities. It aims to facilitate exchange between artists and address that sense of isolation, by bringing people who have been through the fire together with those that are in the thick of it.
The network, which will recruit campaigning organisations and artists networks from around the world, aims to form an executive body that will call governments to account. Index on Censorship is part of this network, which connects, according to Reitov, “a bit over 1,200 organisations all over the world”.
“We have the ambition to analyse the mechanisms and effects of arts censorship,” says Reitov. “Several Artsfex members will take part in a UN meeting on artistic freedom in Geneva in December this year. The UN Special Rapporteur on culture (Farida Shaheed) has decided to make a report on artistic freedom, and all UN member states are now receiving a questionnaire on how they regulate the arts and protect artistic freedom. Our hope is that in the future Artsfex will help keeping governments accountable to their treatment of artists.”
The launch of Artsfex took place against the backdrop All that is banned is desired — the first ever international conference on artistic freedom of expression in Oslo last month.
The conference organisers, Freemuse and Fritt Ord, had decided to turn the platform over exclusively to the stories of practicing artists who had experienced censorship. Over two days, 25 artists from Burma, North Korea, Egypt, Cuba, Russia, Zimbabwe, South Africa, Palestine, Syria, Tunisia, China, Turkey, Tibet and Mali gave their accounts or performed.
Each story told how a play, an album, a painting, an installation, an image or an idea had unleashed extraordinary levels of violence, hostility, threats, and prejudice towards the artist. The aggressors took all forms from corporate community, government or religious groups. Each artist’s decision not to capitulate, to stand up for their right to express themselves brought them into situations of extreme personal danger and harm, risking their life and health, liberty, career, family and community relations.
A man is in solitary confinement, in a tiny, windowless cell. By straining through the bars of his cell, he can just see the edges of moonlight. He paces restlessly and in a moment of inspiration, takes the plastic bowl — the only concession to comfort in his cell — places it carefully just outside the bars and pees into it. As the pee settles, the ripples and bubbles subside, the reflected image of the full moon comes into sharp focus. The prisoner smiles at the moon.
This is the synopsis one of the short films shown at the opening presentation of the conference. The film was made by Burmese comedian, film maker and activist Zarganar, who, with fellow film-maker Min Htin Ko Ko Gyi, told of the power of art and the imagination to withstand brutal treatment by the military junta in Burma.
Bringing these artists together for the first time was an achievement, the result of four years of research and planning. The shared ground between them gave rise to countless connections, forging plans and future collaborations. Four of the participating artists will join an artist roundtable discussion Index has organised in the lead up to our Taking the Offensive conference in London on 29 January 2013 at the Southbank Centre, to defend artistic freedom of expression.
In nearly all cases the artists acknowledged a deep sense of isolation while the media storms, community conflicts and lawsuits raged around and because of them. Despite the support from family, friends, other artists, the theatre or the gallery and in some cases the general public, each artist had to find an extraordinary level of personal courage that was needed to keep going day after day, to stand by the integrity and importance of what they wanted to say.
“Freemuse has already documented more than hundred incidents of arts censorship in the past six months…. My feeling is that this is unfortunately only the tip of the iceberg,” concludes Reitov.

Abbasov reports for the newspaper Ayna-Zerkalo and for the Institute for War & Peace Reporting, which aims to give voice to people at the front line of conflict and crisis. On 9 September 2011, after Abbasov investigated the activities of a local oil company, the State Oil Company of Azerbaijan (SOCAR) sent bulldozers to his family’s home. SOCAR claimed ownership of the site as part of a project to develop local oil resources with Global Energy Azerbaijan Ltd. His parents and brother were hospitalised after being attacked by the company’s security service during the incident. No eviction notice had been lodged in a court, as is required by law, and no neighbouring residences (including that of the parliamentary speaker) were disturbed. It is believed that bulldozers targeted the journalist’s home because of his work monitoring human rights. The violence, threats, and harassment of Abbasov and his family continues. Later that month, his parents were again attacked at their home. The perpetrators arrived in a car bearing government licence plates. One reportedly said: “Tell Idrak to get smarter, or we will cut off his ears.” The Azerbaijanii government is notorious for using legal loopholes to threaten its opponents. Last year the home of human rights activist Leyla Yunus, the founder of the Institute for Peace and Democracy, was bulldozed on 11 August 2011 on a similar pretext. As attention focuses on Azerbaijan in 2012, with the country hosting the Eurovision Song Contest and the Internet
Goverance Forum, human rights violations show no sign of stopping.[/staff][/vc_column_inner][vc_column_inner width=”1/3″][staff name=”Nabeel Rajab, Bahrain Center for Human Rights” title=”Advocacy” color=”#28a7cc” profile_image=”81050″]The Bahrain Centre for Human Rights (BCHR) has played a crucial role in documenting human rights violations, political repression and torture in the gulf kingdom. Despite efforts to silence and discredit it, the BCHR has kept international attention on the brutal government crackdown that began last February. It has prevented the Bahrain government from whitewashing its international image, and at times when news media were severely restricted and foreign journalists barred, it acted as a crucial source of alternative news. Former BCHR president Abdulhady Al Khawaja is one of eight activists serving life sentences for peacefully protesting at the now-demolished Pearl Roundabout. Like many other activists he claims he has been tortured in prison. It is widely reported that BCHR employees regularly experience threats, violence and harassment. In January 2012, BCHR president Nabeel Rajab was severely beaten by security forces while peacefully protesting.[/staff][/vc_column_inner][vc_column_inner width=”1/3″][staff name=”Ali Ferzat” title=”Arts Award” color=”#28a7cc” profile_image=”81049″]Syrian cartoonist Ali Ferzat has been called “an icon of freedom in the Arab world”. He has spent decades ridiculing dictators in more than 15,000 caricatures. His depictions of President Assad and the police state have helped galvanise revolt in Syria. In August 2011, Ferzat was wrenched from his vehicle in central Damascus by pro-Assad masked gunmen who beat him badly and broke his hands. Passers-by found Ferzat dumped at the side of a road; his briefcase and the drawings inside it had been confiscated by his attackers. The BBC’s Sebastian Usher described the attack as a sign of Syria’s “zero tolerance” for dissent; a month earlier the dissident composer Ibrahim Al Qashoush was found dead, his vocal chords removed. Ferzat earned regional and international recognition in the 1980s with stinging cartoons of officials, autocrats and dictators including Saddam Hussein and Muammar Gaddafi. Hussein called for Ferzat’s death in 1989 after an unfavourable portrait of him was exhibited in Paris, and Ferzat’s cartoons are banned in Libya and Jordan. In 2000, he launched the publication Al Domari; Syrian authorities forced its closure three years later. Ferzat is undergoing rehabiliation in Kuwait in order to regain the use of his fingers.[/staff][/vc_column_inner][/vc_row_inner][vc_row_inner][vc_column_inner width=”1/3″][staff name=”Freedom Fone” title=”The Google Innovation Award” color=”#28a7cc” profile_image=”81048″]Kubatana is an NGO based in Harare, set up by Brenda Burrell, Bev Clark and Amanda Atwood. It encourages ordinary Zimbabweans to use information communication technology (ICT) to advocate, mobilise and lobby. One of their main focuses has been the development of local technologies on the principle that development work should strengthen the potential application of pre-existent resources, rather than innovating solely in high-tech gadgetry for a Western audience. For this reason, Kubatana developed Freedom Fone. A free software, Freedom Fone is a basic, easy to use interactive voice response system that can deliver audio information in any language over mobile phones and landlines. All you need is a telephone (landline, mobile, Skype or similar) and Freedom Fone software on a computer. The software is aimed at organisations or individuals wishing to set up interactive news services for users where the free flow of information may be being denied for political, technological or other reasons. Freedom Fone is designed help bridge the digital divide, to reach out to the 90% of Zimbabweans who do not have internet access. On top of giving people access to information, Freedom Fone can be a tool for circumventing censorship. This is because automated telephone information systems do not require a broadcasting licence. In addition, this type of digital content is not currently subject to censorship.[/staff][/vc_column_inner][vc_column_inner width=”1/3″][staff name=”Memorial Archive of St Petersburg” title=”40th Anniversary Award” color=”#28a7cc” profile_image=”81051″]Index singles out The Research and Information Centre Memorial, which logs the brutal repression suffered by millions in former Soviet countries, for their continued dedication to guaranteeing freedom of information. The centre has demonstrated a fierce commitment to protecting human rights. It not only chronicles the crimes of the Stalinist period, but monitors current threats against those who speak out against injustice. Memorial’s remarkable archive includes letters, diaries, transcripts, photographs, and sound files. Individuals with first-hand experience of Stalin’s terror and the Soviet gulag have donated documentation they had hidden during this brutal period.
The centre is a living tribute to the survivors of Soviet Russia, preserving documentation that many have tried to bury, and continue to conduct their work despite constant threats. In December 2009, a group of men from the Investigative Committee of the Russian General Prosecutor’s Office raided Memorial’s offices, confiscating hard drives and CDs containing its entire archive. The attack was condemned by activists and historians across the globe, and eventually all of the material was returned after a battle in local courts. Memorial’s work is a vivid reminder of the vital and very real risk taken by those who speak out against repression. The award is particularly pertinent in Index’s 40th year. As we explore our own archive and its role in exposing international human rights violations, we are conscious of the often undervalued work of historians and archivists in keeping the memory of these violations alive.[/staff][/vc_column_inner][vc_column_inner width=”1/3″][/vc_column_inner][/vc_row_inner][/vc_column][/vc_row][vc_row][vc_column][vc_custom_heading text=”JUDGING” font_container=”tag:h1|text_align:center” use_theme_fonts=”yes”][vc_row_inner el_class=”mw700″][vc_column_inner][vc_column_text]
Criteria – Anyone involved in tackling free expression threats – either through journalism, campaigning, the arts or using digital techniques – is eligible for nomination.
Any individual, group or NGO can nominate or self-nominate. There is no cost to apply.
Judges look for courage, creativity and resilience. We shortlist on the basis of those who are deemed to be making the greatest impact in tackling censorship in their chosen area, with a particular focus on topics that are little covered or tackled by others.
Nominees must have had a recognisable impact in the past 12 months.
Where a judge comes from a nominee’s country, or where there is any other potential conflict of interest, the judge will abstain from voting in that category.
