Urgent letter to Croatian Minister of Justice: Do not extradite whistleblower Jonathan Taylor

Dear Minister,

Jonathan Taylor is a whistleblower; he is a witness to a crime who has cooperated with law enforcement bodies in seven different jurisdictions and should be protected as such.  He has been in Croatia for nearly 10 months appealing against a request for extradition from Monaco.  Now that the Supreme Court of Croatia has issued its judgment, the final decision on whether or not to extradite Mr. Taylor is up to you, the Minister of Justice.

The Supreme Court of Croatia fully recognises Mr. Taylor’s status as a whistleblower and for the reasons we set out below, we urge you, the Minister of Justice, to refuse Monaco’s abusive request to extradite Mr. Taylor to Monaco and to allow him to return home to the United Kingdom immediately.  

Mr. Taylor is a British national who, during the course of his employment as a lawyer for the Dutch-listed oil industry firm SBM Offshore N.V., with its main office in the Principality of Monaco, uncovered one of the largest corruption and bribery scandals in the world that resulted in criminal investigations in the United Kingdom, United States of America, Netherlands, Switzerland and Brazil. His evidence contributed to the company paying fines amounting to over US$800 million and, to date, the imprisonment of three individuals directly involved in the scandal, including the former CEO of SBM Offshore N.V.

Monaco to date has failed to initiate a single criminal investigation into highly credible and well documented allegations of bribery and corruption on the part of SBM Offshore.  Instead, it has targeted the one person who blew the whistle and brought public scrutiny to such widespread financial crimes.

On 30 July 2020, over eight years after blowing the whistle on corruption, Jonathan travelled to Dubrovnik, Republic of Croatia for a family holiday.  He was arrested at the airport on the basis of a communication issued by Monaco on what was originally stated to be allegations of bribery and corruption. Not only do these allegations have no proper basis in law or fact and constitute an abuse of process but crucially, Mr. Taylor, his lawyers and the Croatian Courts have since been informed in writing that Mr. Taylor is wanted for questioning to determine whether or not to charge him.

At no stage did the law enforcement or judicial authorities in Monaco seek his extradition from the United Kingdom, where Mr. Taylor has lived since 2013, until he was apprehended in Dubrovnik, for the very reason that they knew it would not succeed.

Mr. Taylor has made it clear since 2017, when he first became aware that his former employer, the Dutch listed SBM Offshore N.V. had lodged a criminal complaint in Monaco three years earlier, that he would answer any questions the authorities had of him from the United Kingdom, either remotely or in person.  And since his unlawful detention in Croatia, the offer to answer questions there has been repeated on the agreement that he is able to return home to the United Kingdom.

For Jonathan to be returned to Monaco to face questioning in order to determine whether charges should be laid amounts to a clear act of retaliation for his having disclosed the corrupt practices of a major offshore oil firm and one of the largest private sector employers in the small principality.

In March 2021, after the Supreme Court of Croatia partially upheld a second appeal against extradition, the Dubrovnik court was ordered to seek further clarification from the Monegasque authorities regarding the status of the criminal proceedings for which Mr. Taylor was allegedly charged.  A letter from the Director of Judicial Services in Monaco sent on 1 March 2021 confirmed there Mr. Taylor is not charged with anything as there are no criminal proceedings, nor is there any execution of a judgement for which he is wanted – which are the only two valid legal bases for seeking extradition.  In fact, Interpol confirmed yet again on the 23rd March 2021 that Mr. Taylor is no longer subject to Interpol Red Notice. This after Monaco withdrew the arrest warrant in December 2020.

Further, now that Mr. Taylor’s status as a whistleblower has been confirmed by the Supreme Court of Croatia, even if the Minister accepts that conditions for extradition have been met, in light of Croatia’s duties and obligations under the EU Directive on the protection of whistleblowers and the clearly retaliatory nature of the Monegasque request to extradite Mr. Taylor for questioning, we humbly submit that the decision by the Minister should be to reject it.

Croatia is part of the European Union and one of the 27 Member States which must transpose the EU Directive on the protection of whistleblowers into its national legal system by December 2021. The Directive seeks to harmonise protections for those who report wrongdoing and corruption across Europe. It is crucial that Croatia upholds both the spirit and obligations of the Directive to ensure that whistleblowers are protected by law and this includes ensuring they are immune from civil and criminal liability for having blown the whistle. In a case of such serious corruption like this one, it is essential that vital anti-corruption whistleblower protections do not fall down between borders. To do otherwise, allows those involved in corruption to send a chilling warning to whistleblowers and investigative journalists across the globe that undermines all the efforts of the European Union and the Croatian Government to prevent and root out the corruption that undermines the fabric of its societies and the well-being of its people.

For these very important reasons, and because of his protected status as a whistleblower, we, the undersigned, urge you, the Minister of Justice, to uphold the Rule of Law, reject the extradition order and allow Jonathan Taylor to return home immediately.

Acting Attorney General Monty Wilkinson:

We, the undersigned press freedom, civil liberties, and international human rights advocacy organizations, write today to share our profound concern about the ongoing criminal and extradition proceedings relating to Julian Assange, the founder of Wikileaks, under the Espionage Act and the Computer Fraud and Abuse Act.

While our organizations have different perspectives on Mr. Assange and his organization, we share the view that the government’s indictment of him poses a grave threat to press freedom both in the United States and abroad. We urge you to drop the appeal of the decision by Judge Vanessa Baraitser of the Westminster Magistrates’ Court to reject the Trump administration’s extradition request.

We also urge you to dismiss the underlying indictment.

The indictment of Mr. Assange threatens press freedom because much of the conduct described in the indictment is conduct that journalists engage in routinely—and that they must engage in in order to do the work the public needs them to do. Journalists at major news publications regularly speak with sources, ask for clarification or more documentation, and receive and publish documents the government considers secret. In our view, such a precedent in this case could effectively criminalize these common journalistic practices.

In addition, some of the charges included in the indictment turn entirely on Mr. Assange’s decision to publish classified information. News organizations frequently and necessarily publish classified information in order to inform the public of matters of profound public significance.

We appreciate that the government has a legitimate interest in protecting bona fide national security interests, but the proceedings against Mr. Assange jeopardize journalism that is crucial to democracy.

The Trump administration positioned itself as an antagonist to the institution of a free andunfettered press in numerous ways. Its abuse of its prosecutorial powers was among the most disturbing. We are deeply concerned about the way that a precedent created by prosecuting Assange could be leveraged—perhaps by a future administration—against publishers and journalists of all stripes. Major news organizations share this concern, which is why the announcement of charges against Assange in May 2019 was met with vociferous and nearly universal condemnation from virtually every major American news outlet, even though many of those news outlets have criticized Mr. Assange in the past.

It is our understanding that senior officials in the Obama administration shared this concern as well. Former Department of Justice spokesperson Matthew Miller told the Washington Post in 2013, “The problem the department has always had in investigating Julian Assange is there is no way to prosecute him for publishing information without the same theory being applied to journalists.”

It was reportedly the press freedom implications of any prosecution of Mr. Assange that led Attorney General Eric Holder’s Justice Department to decide against indicting him after considering doing so.
It is unfortunately the case that press freedom is under threat globally. Now more than ever, it is crucial that we protect a robust and adversarial press—what Judge Murray Gurfein in the Pentagon Papers case memorably called a “cantankerous press, an obstinate press, an ubiquitous press” —in the United States and abroad.

With this end in mind, we respectfully urge you to forgo the appeal of Judge Baraitser’s ruling, and to dismiss the indictment of Mr. Assange.

Biden’s first week in office and what it means for free speech

President Joe Biden has signed a number of executive orders in the early days of his presidency that will impact upon free speech.

How the 46th president of the United States of America will be remembered in terms of protecting free speech will become apparent in the coming years. But, after four years of President Trump’s attacks on the media and introducing legislation that restricted a range of freedoms, the early days of the Biden’s administration have come as a welcome relief.

Of the more than two dozen orders signed, at least six will have ramifications for Americans in terms of their freedom of expression.

Index takes a look at how each will do just that.

Preventing and combating discrimination on the basis of gender identity or sexual orientation

Perhaps the most notable executive order signed in the last week is the order to prevent discrimination on the basis of sexual orientation or gender identity. Discriminatory bans on LGBT+ people can often stop them from speaking out.

The order says: “Children should be able to learn without worrying about whether they will be denied access to the restroom, the locker room, or school sports.  Adults should be able to earn a living and pursue a vocation knowing that they will not be fired, demoted, or mistreated because of whom they go home to or because how they dress does not conform to sex-based stereotypes.”

The order will end the ban on transgender students competing in sports teams for their identified gender.

Commenting on the order, the American Civil Liberties Union (ACLU) said: “The ACLU urges the Biden administration to not only roll back Trump administration policies discriminating against transgender and non-binary people, but take action to more fully recognize transgender and non-binary people. The ACLU’s priority for the Biden administration is an executive order related to accurate ID documents.”

Rescinds the Trump administration’s 1776 Commission, directs agencies to review their actions to ensure racial equity

Trump planned so-called ‘patriotic education’ in America’s schools, which raised alarm over First Amendment issues concerning forcing schools to teach children in a certain way.

The 1776 commission, set up in September 2020 and signed by executive order in November, essentially explored which parts of American should be taught and how they should be interpreted.

Announcing the commission Trump said: “We must clear away the twisted web of lies in our schools and classrooms and teach our children the magnificent truth about our country. We want our sons and daughters to know that they are citizens of the most exceptional nation in the history of the world.”

Biden rescinded the commission – which was ridiculed by historians – on his first day in office in an executive order on advancing racial equity.

Inclusion of non-citizens in the Census and apportionment of congressional representatives

When President Trump signed an executive order to not include people in censuses based on their immigration status, some viewed this as an infringement of their 14th amendment rights.

This section of the American constitution grants citizenship to all “born or naturalised within the United States” and gives them “equal protection under the laws”.

To not recognise illegal immigrants via a census may imply such people are no longer afforded such protections, key to ensuring their right to liberty and free speech. Biden’s order reverses this.

Fortifies DACA after Trump’s efforts to undo protections for undocumented people brought into the country as children

A new order reinstates the policy known as DACA or the Deferred Action for Childhood Arrivals, which had been implemented during the Obama presidency.

DACA ensures those undocumented immigrants who arrived in the USA under the age of 16 could apply for a permit allowing them to work legally in the country, providing they have a high school diploma and (next to) no criminal record.

Trump rescinded the policy and subsequently his Department of Justice claimed information given by those applying for the permits could later be used against them to deport them, despite the act of declaring information on the form being part of a process of establishing their legal entitlements. This was a clear violation of the protection of their free speech.

Reverses the Trump administration’s restrictions on US entry for passport holders from seven Muslim-majority countries

The First Amendment protects the sharing of information and speech. Trump’s ban on citizens of seven predominantly Muslim countries was an obvious barrier to this.

The policy also raised questions over the respect of religious freedom and reached the Supreme Court in 2018, where it was upheld.

Dissenting voices at the time were expressed by Justice Sonia Sotomayer who – joined by Ruth Bader Ginsburg – said: “The United States of America is a Nation built upon the promise of religious liberty. Our founders honoured that core promise by embedding the principle of religious neutrality in the First Amendment. The Court’s decision today fails to safeguard that fundamental principle.”

When Biden reversed the policy on 20 January, the White House released a statement saying: “The United States was built on a foundation of religious freedom and tolerance, a principle enshrined in the United States Constitution.”

Biden overturns ban on transgender troops

One of the most controversial policies brought in under the administration of President Donald Trump was the ban on transgender members of the military.

Transitioning troops were previously required to be stable in their gender for a minimum of 18 months before being allowed to serve. A win for Assange, but not for free speech

This week’s decision not to extradite WikiLeaks founder, Julian Assange, to the USA to stand trial for charges of espionage came as welcome relief to Assange’s family and supporters. However, he remains detained at London’s high-security Belmarsh prison after the judge refused bail citing concerns he would abscond.

Before we consider the ruling against extradition as a victory for free speech it’s worth exploring the details of District Judge Vanessa Baraitser’s ruling which risk creating a chilling effect on public interest journalism. 

Judge Baraitser’s ruling at no stage allowed for the protections governed by Article 10 of the UK Human Rights Act to halt the extradition. Instead, in denying the US Government’s request to extradite Assange, Baraitser concluded that “the mental condition of Mr. Assange is such that it would be oppressive to extradite him to the United States of America”.

In doing so, the judge accepted the testimony of medical experts who said that Assange represented a potential suicide risk if he were to be incarcerated in the USA; Jeffrey Epstein’s suicide and Chelsea Manning’s attempted suicide are both mentioned in the ruling.

The risk was exacerbated because Assange would likely face so-called special administrative measures which would limit his communication with the outside world and visiting rights.

Baraitser’s decisions regarding the key legal arguments of Assange’s defence are cause for concern and risk creating a precedent which would prevent journalists from publishing sensitive information in the public interest and the ruling appears to have extended the scope of Britain’s Official Secrets Act.

As part of the extradition request, the court had to be satisfied, to the criminal standard, that Assange’s conduct would constitute an offence under the law of England and Wales.

Baraitser said in the judgment: “I have found that Mr. Assange’s conduct is capable of amounting to an offence in England and Wales. It follows that I do not accept that the mere fact charges are brought in the US demonstrates that they are brought in bad faith.”

This argument appears to be based on the premise that Assange’s actions would have fallen foul of section 5 of the UK’s Official Secrets Act (OSA) 1989 which applies to individuals, including publishers, who are not the original leaker of the information. This criminalises “those who disclose protected materials which are damaging and which they have disclosed knowing, or having reasonable cause to believe, would be damaging”. 

The US government’s argument is similar and maintains that under US law a free speech defence does not necessarily cover classified information even if it is in the public interest and they said Assange had disclosed materials “that no responsible journalist or publisher would have disclosed” when WikiLeaks published its full archive of 251,000 secret US diplomatic cables without redacting the names of sources.

It is this assertion that has led the US government to charge Assange under the 1917 Espionage Act, which is primarily designed for spies, rather than journalists or publishers. 

Before the verdict, Assange’s partner Stella Moris told Index: “They say Julian published information that was secret and therefore he can be prosecuted over it. They never used [this act] to prosecute someone publishing information for the public.”

The defence argued that Assange was “doing no more than engaging in the ordinary and lawful conduct of the investigative journalist”, which is protected by Article 10.

However, Baraitser stated that the Article 10 right to freedom of expression “is not absolute”. 

She added: “In my judgment, notwithstanding the vital importance in guaranteeing freedom of the press, the provisions of the OSA 1989, where they are used to prosecute the disclosure of the names of informants, are necessary in a democratic society in the interests of national security.”

She also contested Assange’s assertion that he was acting as a responsible journalist.

“The difficulty with this argument is that it vests in Assange the right to make the decision to sacrifice the safety of these few individuals, knowing nothing of their circumstances or the dangers they faced, in the name of free speech. In the modern digital age, vast amounts of information can be indiscriminately disclosed to a global audience, almost instantly, by anyone with access to a computer and an internet connection. 

“Unlike the traditional press, those who choose to use the internet to disclose sensitive information in this way are not bound by a professional code or ethical journalistic duty or practice. Those who post information on the internet have no obligation to act responsibly or to exercise judgment in their decisions. In the modern era, where ‘dumps’ of vast amounts of data onto the internet can be carried out by almost anyone, it is difficult to see how a concept of ‘responsible journalism’ can sensibly be applied.”

If the judge does allow the US appeal in the next two weeks and Assange is extradited, he will not have recourse to protection under the First Amendment laws which protect freedom of speech. Incumbent Secretary of State Mike Pompeo has previously argued that First Amendment privileges should not be afforded to Assange and WikiLeaks.

Pompeo’s comments were deemed by many to be politically motivated in order to deter the likes of the WikiLeaks founder from repeating similar actions. Being the first administration to use the Espionage Act in such a way seemed to support this. 

But Baraitser once again rejected the defence’s argument, deciding that: “The defence points to comments made by Attorney General Sessions a week after Mr. Pompeo’s speech in April 2017 that “[journalists] cannot place lives at risk with impunity,” that prosecuting Assange was a “priority” for the new administration, and that if ‘a case can be made, we will seek to put some people in jail’. However, as the US points out, these comments appear to be no more than statements of what is perhaps obvious, and conditional on whether criminal liability can be established. There is nothing sinister in bringing a prosecution ‘if a case can be made’.”

Again, the Espionage Act is a factor here as it does not contain a public interest defence. Therefore, charging journalists under this Act is considered by many as one-sided and unfair as it removes the protections free speech laws afford.

Index’s position is clear. Governments, authoritarian or not, in order to protect our collective human rights and to enable power to be held accountable, must be open to scrutiny and are a fair target for investigative journalists, even if the definition of what constitutes an investigative journalist is no longer as clear as it once was. 

The issue at hand is not about Assange the person, but rather the very principle of a free and fair press which operates in the public interest.  That is the principle at stake in this judgment.

Other press freedom organisations, such as the International Federation of Journalists, Reporters Without Borders and the Centre for Investigative Journalism, have also expressed their disquiet with the ruling. 

We recognise that there are certainly questions about the manner in which Assange published the information without redacting the names of journalists and activists, a move which was condemned by a number of newspapers which worked with WikiLeaks to reveal the contents of the diplomatic cables. 

However, the fact remains that much of the information published about the actions of certain governments was clearly in the public interest.

If the US government can decide on a case-by-case basis who is a spy and who is a journalist then this makes the job of the latter that much more challenging. The fear that investigative journalists may be extradited will mean stories that need to be brought to light will remain in the darkest of shadows.[/vc_column_text][/vc_column][/vc_row][vc_row][vc_column][three_column_post title=”You may also like to read” category_id=”5641″][/vc_column][/vc_row]
