Turkish journalist, author and filmmaker Can Dündar spoke at the House of Commons last week about the state of politics and media freedom in Turkey. The event was hosted by the Centre for Turkey Studies and chaired by Scottish Liberal Democrat peer Lord Jeremy Purvis of Tweed.
“I’ve come from the biggest prison for journalists in the world,” Dündar told the audience. “There are close to 40 journalists imprisoned in Turkey — we are competing with China.”
Dündar, the editor-in-chief of Cumhuriyet, was sentenced to five years and 10 months in prison on 6 May 2016, just hours after a failed attempt on his life by a gunman. Along with Cumhuriyet journalist Erdem Gül, he was convicted of “leaking secret state information” for the paper’s reports claiming that Turkey was sending weapons to Islamists in Syria.
The pair were arrested and detained in November 2015, just days before a meeting of the EU heads of state with Turkey, the first meeting of its kind in almost six decades. “Turkey was not on the agenda because it was a democratic country, but because of the need for Turkey regarding the migrant issue,” Dündar explained.
Although he has been out of prison since February 2016, when he returns to Turkey — which he defiantly said he will — he risks serving his sentence.
Watching from his TV in solitary confinement during his stint in prison, Dündar learned of the deal that Turkey would keep asylum seekers from crossing into Europe, and in return the country would receive €3bn and visa exemptions.
Asylum seekers were “held hostage” by Turkey, Dündar said. “I was waiting until the end of the conference hoping there would be some mention of the free press, but there was nothing.”
He has been a journalist for 35 years, working in television and in print. “Throughout all these years working in the media, it has never been a paradise, but I don’t think it’s ever been quite as hellish as it is at the moment,” Dündar added. “We face oppression and censorship.”
The EU was due to release a report on Turkey’s lack of press freedom just weeks before the summit and in time for the Turkish general election. Dündar told the audience that following a meeting between Turkish President Recep Tayyip Erdoğan and EU officials, the report was delayed until after the general election.
Erdoğan’s Justice and Development Party achieved electoral victory and a week later, the report was published. “The human rights record of Turkey was condemned in strong terms,” Dündar said.
“For those of us who grew up in Turkey, in view of the Western, democratic ideals, this was very disappointing,” Dündar told the audience. “Europe is a great ideal, something to aim for.”
Dündar has lived through three military coups in Turkey. “Back then there was serious censorship,” he said. “But Erdoğan has succeeded in doing something the military couldn’t: he has instructed the media moguls close to him to buy up newspapers and TV stations, establishing a coup of friendly media.”
Dündar explains that these Erdoğan-friendly groups — mainly rich civil engineering companies receiving favours from the president — control 60% of the media, while opposition media make up only about 5-10% of the market.
Critics of Erdogan face further financial difficulty in the form of harsh fines for “insulting” Erdogan — of which there have been over 3,000 cases. “The president takes any criticism as an insult,” Dündar explained, joking: “He is the most insulted president in the world.”
Critical media outlets also find it difficult to generate revenue through advertising because “any company advertising with us will also face sanction”. The media faces further pressures in the form of “severe tax bills” and the intimidation of journalists to “toe the line”.
When journalists like Dündar aren’t visiting colleagues in prison and attending court cases in support of friends, they are preparing for their own hearings. And while they often win international awards for their work, “we can’t eat those so we have to create resources”.
Although the situation in Turkey looks unpromising, Dündar told the audience to remember that “there is another Turkey that believes in democracy and secularism”. There exists a “great existential struggle” and the aim for those like him “is to overcome this fear, but we have to be brave and we have to unite”.
In this struggle, Dündar asked the people of Europe for “support and solidarity” before Turkey “becomes a fascist regime”. He called on the Western media to do more to draw attention to the crimes of Erdoğan.
As the Greek government prepares to open a public consultation on the tender for new broadcast licenses, the country’s private TV owners have escalated their criticisms of a controversial new media law passed on 11 February.
The law aims to regulate the country’s media market and includes a competitive bidding process for limited private broadcast licenses. Nikos Pappas, the minister responsible for its implementation, announcedat a Syriza party meeting on 23 March his intention to launch the open international bid after the public consultation.
The changes will not affect the country’s public broadcaster ERT.
Panos Kyriakopoulos, president of the Association of Private TV Stations of National Range (EITISEE), criticised the government’s move, pointing out that the industry group was only invited to discuss the proposed legislation late in the process, when the draft bill had already been approved by a parliament committee. He added that EITISEE would appeal to the Greek Council of State and has already contacted the relevant EU agencies.
While broadcast television licensing has not been harmonised at an EU level, the changes to the Greek broadcast regime are being driven by the financial bailout. Under the rescue package, a European Commission spokesperson confirmed that Greece had committed to launch an international tender for broadcasting licenses.
From the Syriza-led government’s point of view, the new licensing process will bring order to broadcasting environment and fight corruption. Political opponents see the licensing regime as an attempt to take full control over the country’s media.
“We want financially viable media, because if this is not the case, they end up with financial holes and large loans, putting pressure on the political system to intervene in banks,” said Pappas.
Kyriakopoulos claims that whatever is being said about EITISEE member’s finances is “lies”.
“Our members do not have a euro of arrears to the state budget, the social security funds and the banks,” Kyriakopoulos told Index on Censorship. “Moreover, no loan does belong to the category of red loans.”
However, not everyone agrees with Kyriakopoulos.
“In our country the private TV channels have dominated the media environment for 25 years without ever having been given licenses and under a provisional legal status. Regulation is not only necessary but it’s a precondition for the smooth functioning of the market,” said Matina Papachristoudi, a journalist with the magazines Digital TV Info and Hot Doc, and a blogger at mediatvnews.gr.
For its part, EITISEE said that after the transition from analog to the digital age, the licensing framework has changed as in other European countries. “The TV channels do not have frequencies anymore,” Kyriakopoulos said. “It’s the network provider which has been given the frequencies, and this is Digea, following an international tender.”
According to Papachristoudi, non-authorised stations are “clients” of Digea, a digital network operator.
The main fight between the government and the Greek private TV is over the number of licences to be sold. Currently, eight national TV channels are operating in Greece. The new law allows for only four. Based on research from the University Institute of Florence, the government maintains that only four channels are viable.
“This is unprecedented for a democratic state where the open market is established,” Kyriakopoulos said. “The government cannot impose how many licences will be allowed within a sector, based on a revenue approach; the open market regulates this.”
“The issue will be judged in the supreme court, to which the channel owners will appeal,” Papachristoudi said. “Personally, I think it is not a restriction on freedom of expression, but an attempt to control the broadcasting landscape under new conditions.”
Most controversially, the government has decided to conduct the international bidding process itself, rather than have the National Council for Radio and Television (NCRTV), Greece’s independent regulatory authority, run the tender. NCRTV is designated by the Greek constitution as the body responsible for such a process.
Kyriakopoulos said this “abolishes the independence of the press” and accused the government of creating a “kind of oligopoly with few stations”, which are easily “manageable” and “better controlled … either through the distribution of state advertising or by threatening to pull their licences, if they do not obey the requirements imposed”.
The government opted to oversee the process due to a deadlock with the major opposition party in parliament over the appointment of NCRTV board members. The Greek prime minister, Alexis Tsipras, accused the dominant opposition party of wanting to “cancel the contest”.
“Mr. Mitsotakis is a hostage to the various interests and the TV contractors and denies the consensual establishment of the NCRTV,” the prime minister’s office said in a statement. “His aim is to cancel the contest, and those who had for so many years a free use of public frequencies, not to pay anything.”

An important step has been taken in Turkey’s painful negotiations with the EU. Turkey submitted to the Turkey-EU summit, held in Brussels on 7 March, several proposals, including the following:
-Move to 1 June 2016 the implementation of the readmission agreement, which will make Turkey contractually obligated to readmit any person who travelled to an EU country from Turkey if he or she was not admitted by that EU country;
-For every citizen of a third country readmitted by Turkey, the EU should promise that it will admit one refugee from Turkey, and the readmission expenses will be covered by the EU. This will protect Greece from the uncontrollable flow of refugees arriving in the Greek islands from Turkey’s coastal towns. However, difficulties may arise in finding an EU country that will fulfill this commitment, and Turkey’s refugee problem may continue to increase since the arrival of refugees from Syria may not stop before Syria is stabilised.
-If the readmission agreement enters into force by 1 June 2016, visa-free travel will be possible for Turkish citizens wishing to visit the Schengen countries.
-Turkey asked for an additional 3 billion euros, to be spent for refugee-related projects.
-Turkey’s EU accession process will be reactivated by opening new negotiation chapters that were blocked for political reasons, either by the EU Council or by individual countries, such as France and the Greek Cypriot administration. This positive commitment may not guarantee that Turkey will become a member of the EU but may lead to the resumption of the reforms that Turkey has to comply with under the Copenhagen criteria and the Maastricht economic criteria.
The deal will be discussed once again with Turkey before the EU Council meeting on 18 March.
Turkey’s refugee problem may thus be slightly alleviated if the genuine efforts by Chancellor Angela Merkel of Germany succeed. The bulk of the burden, however, will still remain on Turkey’s shoulders. Turkey will have to accommodate the refugees, mainly from Syria, until the EU countries select among them the eligible ones. The EU does not want to assume the moral responsibility for the solution of a problem that stems basically from Turkey’s open door policy for Syrian refugees.
The good side of the deal for Turkey is that the EU is giving Turkey a helping hand. If Chancellor Merkel hadn’t taken the lead to alleviate Turkey’s refugee burden, Turkey would have been left alone to solve it. If the deal is implemented properly, Turkey will receive not only an easing of its refugee burden but will make progress in other areas: One of them is the grinding to a halt of Turkey’s EU accession process. Both Turkey and the EU had lost their appetite for the continuation of the process. Not only the refugee problem but also the entire Syrian crisis, and beyond it the other crises in various Middle Eastern countries, may have demonstrated to certain EU countries that cooperation with Turkey could facilitate the solution of the problems that the EU may face in the Middle East. Therefore, certain EU countries may have decided to revisit the question of the reactivation of Turkey’s EU accession process.

On Friday night, security forces stormed Zaman, the widest-circulating Turkish newspaper. Though many Turkish news outlets studiously avoided covering the raids, the screens of international news channels were full of images of Turkish police using tear gas and water cannon against protestors trying to protect their paper. Particularly striking were the injuries to young women wearing Islamic headgear, the very segment of the community, which the ruling Justice and Development Party (AKP) once vowed to defend.
The seizure of a news organisation by placing it into court-appointed administration is not trivial. The Zaman group employs some two thousand people, runs a nationwide network of correspondents and puts out an English language daily, Today’s Zaman, which has an international following on the web. It is impossible to imagine a court in any country with the slightest pretension of being democratic acting with such impunity.
The final headline of the independent version of Zaman was that there could be no legal basis for the takeover. Indeed, Article 30 of the Turkish Constitution reads: “A printing house and its annexes, duly established as a press enterprise under law, and press equipment shall not be seized, confiscated, or barred from operation on the grounds of having been used in a crime.” (As amended on May 7, 2004; Act No. 5170)”
It is no secret that Zaman demonstrated fidelity to the movement associated with the exiled cleric, Fethullah Gülen. The paper once supported the rise of AKP but in recent years has been a bitter critic. The legal document, which placed Zaman’s parent company into court-appointed administration, relies on the testimony of an anonymous witness who maintains that the editorial policy was dictated by what it calls the Fethullah Terror Organisation (FETÖ in its Turkish acronym). This in turn is guilty of conspiring with the outlawed Kurdistan Workers Party (PKK). It is enough to point out that the existence of FETÖ is at best hearsay, at worst the invention of subeditors in the pro-government press – never mind that Zaman itself once took a more hawkish line towards the PKK than the government itself.
According to reports reaching P24, the prosecutor struggled to find a court which would accede to his request. The Zaman building is in the Bakırköy province of Istanbul and comes under its jurisdiction. However, the request in the Bakırköy court was refused. Finally another, more friendly court acceded to the prosecutor’s demand, even though it is dubious whether it had the competence to do so.
The paper may not be guilty of treason but is has been guilty of apostasy – of having turned its back on AKP and President Tayyip Erdoğan in particular. Since then the two have been in mortal combat. Loyalists to the Gülen movement and the Zaman group in particular pursued corruption allegations against leading government officials in December 2013.
By forcing Zaman’s takeover the government lays itself open to universal condemnation. Turkey, once a proud EU applicant, now plumbs the lower depths of global rankings of transparency and free expression. Sadder still, this does not seem to trouble it a jot.
“The timing is a slap in the face,” according to a diplomat quoted in The Financial Times. “The seizure came during a visit to Istanbul by Donald Tusk, the European Council president, and two days before Angela Merkel, the German chancellor, is to see Ahmet Davutoğlu, the Turkish premier,” the paper points out. Turkey now calibrates its place in the world not as a democratic standard bearer in a troubled part of the globe but as a buffer zone between Fortress Europe and a tide of Syrian refugees. This, it believes, gives it licence to get away with the murder of a newspaper.
In Turkey all eyes, government and opposition, are on the EU to see if Brussels is prepared to put expediency above principle and if European pubic opinion is prepared to see Ankara give up all pretence of democratic governance in exchange for grudging cooperation on Syria.
It is not just the timing of the EU summit, which is significant. The Constitutional Court recently gave the presidential office a swift kick in the shins with the release from pre-trial detention of the editor-in-chief of Cumhuriyet newspaper along with his Ankara bureau chief. The high court ruled that the charges against them – that printing stories in a newspaper could correspond to treason – were essentially absurd. Since then, newspapers and ministers loyal to the president have been braying for the judges’ blood. The president himself has said he would neither respect nor abide by the high court’s decision and now appears even more determined to draft a new constitution which would allow him to do exactly that.
Not everyone in AKP supports this autocratic trend. There is a small wave of discontent from the old guard who believe a constitution that concentrates even greater powers in presidential hands is a dangerous step. These homegrown dissidents took quiet satisfaction in the court’s defence of Cumhuriyet. So one can see the raid against Zaman as the president re-asserting his authority against these pockets of resistance to one-man rule.
Turkey’s 1982 Constitution was prepared under conditions of martial law. It attempted to dictate a society in which the rights of citizen were subservient to the needs of the state. This rendered it anachronistic before the ink on the Official Gazette was dry. It has constantly been rewritten and there have been consistent demands that it be replaced.
Yet no one, not even in their wildest babblings, ever claimed the current Constitution was insufficiently authoritarian, or that it ceded too little power to the arbitrary whim of government, or that it failed to enshrine the Machiavellian principle that “might makes right”.
No one, that is, until now. As the ink on the printing presses of Turkey’s independent media run dry so too do hopes for the country’s future.
