The wording of Nigeria’s recent anti-gay marriage law is misleading and has provoked a spike in hate crime towards the homosexual community, according to leading human rights lawyer Rommy Mom. The Same Sex Marriage Prohibition Act 2013, which is yet to be published since it was signed into law by President Goodluck Jonathan in January, outlaws gay marriage and relationships. It also makes it illegal for gay people to hold meetings, and outlaws the registration of homosexual clubs, organisations and associations. Those found to be participating in such acts face up to 14 years in jail.
Mom, who was nominated for the Index Freedom of Expression Advocacy Award for his work with Lawyers Alert, visited the Index office to speak about the current situation in Nigeria and the problems facing the LGBT community. “When the title is ‘Same Sex Marriage’ it’s not something many people are able to wrap their heads around…what it has done is to stir up some hate crimes against persons of different sexual preferences,” explained Mom. At the same time, the public are failing to take note of the other implications of the law to homosexuals hidden behind the title.
Mom referred to an attack on a group of at least half a dozen young men in a village on the outskirts of capital Abuja recently after the law was passed. The men, dragged from their homes in the middle of the night by villagers, were assaulted and battered, before the local police detained them. “We have a constitution where people are innocent until proven guilty,” Mom told Index, but that wasn’t the case here, and hasn’t been in many other recent cases.
But why has one word — “marriage” — resulted in an increase in violent crimes against the LGBT community? As Mom explained, the idea of same-sex marriage is a very Western notion (although, as he pointed out, only 19 states in America have legalised the act of civil unions) and is something the Nigerian people are uncomfortable with.
While same-sex marriage was not legal prior to the law coming into force, in some Nigerian cultures, including that of the Igbo people, women have been marrying other women for centuries for the benefit of their husbands — be it for economic or reproductive reasons. “It’s a situation that before now wasn’t there. Sexual differences have always been with us in Nigeria, we’ve lived with it and we’ve accepted it. It might come with some social stigma but people were not going out of their way to want to harm [homosexuals] or to incite hate,” Mom said.
“People have died because someone has labelled them a lesbian or a gay. But that’s what the law has cost in Nigeria.”

More than three weeks after the abduction of over 200 schoolgirls from the northern Nigerian town of Chibok by Boko Haram (BH), an Islamist militant group, the world is finally awake to the tragedy.
While Michelle Obama tweeted a photo of herself displaying the hashtag #BringBackOurGirls, Angelina Jolie said she was “sickened” by the “unthinkable cruelty” and has expressed her anger.
“I heard about it just a few days back when a friend posted an article on Facebook. I was stunned beyond words,” said 19-year old college student Iqra Moazzam, in Karachi, who cannot get over the fact that the girls may have already been sold.
Last week, BH’s leader Abubakar Shekau, threatened to “sell [the girls] in the market” into slavery.
“Not only was the Muslim community slow to respond but the West was also slow to respond,” pointed out Aurangzeb Haneef, who teaches Islamic Studies at the Department of Humanities and Social Sciences at the Lahore University of Management Sciences. He said there was also some discussion on whether the response would have been quicker had the girls been white.
Boko Haram came about in 2009 in an attempt to impose Islamic law in all 36 Nigerian states. It has been behind killing of thousands of people in Nigeria in recent years and known to have links with other radical Islamist groups in North Africa and Sahel.
“I think they have defiled the name of Islam and added one more stain on the Muslim Ummah. I’m infuriated they are calling themselves Muslims; there is not a shred of Islam in their evil deed,” Moazzam said.
And yet surprisingly, there has been no word of condemnation from any religious institution, no indignation from the pulpit by imams during the weekly Friday sermons and no remonstration from the people in the Islamic world.
In September 2012, video-sharing website YouTube put up a 14-minute clip of Innocence of Muslims, produced by an American that was disrespectful of Islam, Muslims and the Prophet Muhammad, which sent a wave of protests throughout the Muslim world. In Pakistan, complete mayhem broke out: 30 people were killed and over 300 were injured.
The 12 cartoons published on 30 September 2005 by the Danish newspaper Jyllands-Posten of Prophet Muhammad, and which the Muslims found extremely and deliberately offensive, led to attempts on the life of the cartoonist and arson attempt made on the newspaper office.
Khalid Zaheer, an eminent religious scholar and vice-president of Al-Mawrid, a foundation for Islamic research and education, explained: “People come to the streets for issues about which they are sensitised by their scholars. Blasphemy is a topic that concerns the ulema (scholars) more because they have literature speaking against it.”
But he said: “Killing in the name of Islam is either considered an exaggerated propaganda, justified jihad, or atrocities done by some enemies who have conspired to malign Islam.” He said the narrow view of the world that is taught in madrassas and promoted in mosques causes non-issues to be made a matter of life and death and real issues to be ignored as if they don’t exist.
Haneef also attributed the inaction on the street to lack of response to the episode by the religious parties. He added: “Since the victims in this case are not Muslims (although some reports suggested that a few of them were Muslims) and since the accused here claim some kind of Islam, therefore, there has been understandable inertia on the part of Islamic parties to criticise BH.”
Unfortunately, pointed out Haneef: “Common Muslims are reluctant to take up issues involving atrocities against non-Muslims. Few people understand that these atrocities are in the name of Islam — Islam is being hurt here — yet they don’t feel compelled enough to raise their voice against BH.”
The same sentiment was endorsed by peace activist, Dr Pervez Hoodbhoy, who is also an academic. “I am sure that most Muslims do not approve of Muslims killing non-Muslims or other Muslims, but this does not raise passions in the same way.”
He also said: “Most Muslims today do disapprove of the mass abduction and sale of the Nigerian girls, but they prefer silence. There is vague discomfort that being too loud might cause Islamic fundamentals to come under scrutiny, something that is best avoided in these dangerous times.”
Hoodbhoy explained that with BH at war with those they consider infidels: “Women captured during tribal wars were part of the war booty and the Holy Quran is completely explicit on the distribution of every kind of booty, including women. Of course, as with slavery, most Muslims regard these verses as meant for those times only.” He said that was the takfiri (a Muslim who accuses another Muslim of apostasy) philosophy of the BH.
Khadeja Ebrahim 12, studying in Class 7, at a British school in Karachi likened the Nigerian militant group to the Tehreek-e-Taliban Pakistan (TTP). “They seem like the Taliban we have in Pakistan, who attacked Malala and believe those seeking western-style education are committing a sin,” she told Index. Asked if she felt scared she nodded saying: “If it can happen in Nigeria, it can happen here in Pakistan and in Karachi too.”
Still, Hoodbhoy, finds the Taliban quite gentle when compared to the BH. “While the TTP does mount suicide attacks, and makes video tapes football matches played with the heads of decapitated Pakistan soldiers, the techniques employed by BH are brutal beyond description.”

In January, Index summarised the U.S. State Department’s “Countries of Particular Concern” — those that severely violate religious freedom rights within their borders. This list has remained static since 2006 and includes Burma, China, Eritrea, Iran, North Korea, Saudi Arabia, Sudan, and Uzbekistan. These countries not only suppress religious expression, they systematically torture and detain people who cross political and social red lines around faith.
Today the U.S. Commission on International Religious Freedom (USCIRF), an independent watchdog panel created by Congress to review international religious freedom conditions, released its 15th annual report recommending that the State Department double its list of worst offenders to include Egypt, Iraq, Nigeria, Pakistan, Tajikistan, Turkmenistan, Vietnam and Syria.
Here’s a roundup of the systematic, ongoing and egregious religious freedom violations unfolding in each.
1. Egypt
The promise of religious freedom that came with a revised constitution and ousted Islamist president last year has yet to transpire. An increasing number of dissident Sunnis, Coptic Christians, Shiite Muslims, atheists and other religious minorities are being arrested for “ridiculing or insulting heavenly religions or inciting sectarian strife” under the country’s blasphemy law. Attacks against these groups are seldom investigated. Freedom of belief is theoretically “absolute” in the new constitution approved in January, but only for Muslims, Christians and Jews. Baha’is are considered apostates, denied state identity cards and banned from engaging in public religious activities, as are Jehovah’s Witnesses. Egyptian courts sentenced 529 Islamist supporters to death in March and another 683 in April, though most of the March sentences have been commuted to life in prison. Courts also recently upheld the five-year prison sentence of writer Karam Saber, who allegedly committed blasphemy in his work.
2. Iraq
Iraq’s constitution guarantees religious freedom, but the government has largely failed to prevent religiously-motivated sectarian attacks. About two-thirds of Iraqi residents identify as Shiite and one-third as Sunni. Christians, Yezidis, Sabean-Mandaeans and other faith groups are dwindling as these minorities and atheists flee the country amid discrimination, persecution and fear. Baha’is, long considered apostates, are banned, as are followers of Wahhabism. Sunni-Shia tensions have been exacerbated recently by the crisis in neighboring Syria and extremist attacks against religious pilgrims on religious holidays. A proposed personal status law favoring Shiism is expected to deepen divisions if passed and has been heavily criticized for allowing girls to marry as young as nine.
3. Nigeria
Nigeria is roughly divided north-south between Islam and Christianity with a sprinkling of indigenous faiths throughout. Sectarian tensions along these geographic lines are further complicated by ethnic, political and economic divisions. Laws in Nigeria protect religious freedom, but rule of law is severely lacking. As a result, the government has failed to stop Islamist group Boko Haram from terrorizing and methodically slaughtering Christians and Muslim critics. An estimated 16,000 people have been killed and many houses of worship destroyed in the past 15 years as a result of violence between Christians and Muslims. The vast majority of these crimes have gone unpunished. Christians in Muslim-majority northern states regularly complain of discrimination in the spheres of education, employment, land ownership and media.
4. Pakistan
Pakistan’s record on religious freedom is dismal. Harsh anti-blasphemy laws are regularly evoked to settle personal and communal scores. Although no one has been executed for blasphemy in the past 25 years, dozens charged with the crime have fallen victim to vigilantism with impunity. Violent extremists from among Pakistan’s Taliban and Sunni Muslim majority regularly target the country’s many religious minorities, which include Shiites, Sufis, Christians, Hindus, Zoroastrians, Sikhs, Buddhists and Baha’is. Ahmadis are considered heretics and are prevented from identifying as Muslim, as the case of British Ahmadi Masud Ahmad made all too clear in recent months. Ahmadis are politically disenfranchised and Hindu marriages are not state-recognized. Laws must be consistent with Islam, the state religion, and freedom of expression is constitutionally “subject to any reasonable restrictions imposed by law in the interest of the glory of Islam,” fostering a culture of self-censorship.
5. Tajikistan
Religious freedom has rapidly deteriorated since Tajikistan’s 2009 religion law severely curtailed free exercise. Muslims, who represent 90 percent of the population, are heavily monitored and restricted in terms of education, dress, pilgrimage participation, imam selection and sermon content. All religious groups must register with the government. Proselytizing and private religious education are forbidden, minors are banned from participating in most religious activities and Muslim women face many restrictions on communal worship. Jehovah’s Witnesses have been banned from the country since 2007 for their conscientious objection to military service, as have several other religious groups. Hundreds of unregistered mosques have been closed in recent years, and “inappropriate” religious texts are regularly confiscated.
6. Turkmenistan
The religious freedom situation in Turkmenistan is similar to that of Tajikistan but worse due to the country’s extraordinary political isolation and government repression. Turkmenistan’s constitution guarantees religious freedom, but many laws, most notably the 2003 religion law, contradict these provisions. All religious organizations must register with the government and remain subject to raids and harassment even if approved. Shiite Muslim groups, Protestant groups and Jehovah’s Witnesses have all had their registration applications denied in recent years. Private worship is forbidden and foreign travel for pilgrimages and religious education are greatly restricted. The government hires and fires clergy, censors religious texts, and fines and imprisons believers for their convictions.
7. Vietnam
Vietnam’s government uses vague national security laws to suppress religious freedom and freedom of expression as a means of maintaining its authority and control. A 2005 decree warns that “abuse” of religious freedom “to undermine the country’s peace, independence, and unity” is illegal and that religious activities must not “negatively affect the cultural traditions of the nation.” Religious diversity is high in Vietnam, with half the population claiming some form of Buddhism and the rest identifying as Catholic, Hoa Hao, Cao Dai, Protestant, Muslim or with other small faith and non-religious communities. Religious groups that register with the government are allowed to grow but are closely monitored by specialized police forces, who employ violence and intimidation to repress unregistered groups.
8. Syria
The ongoing Syrian crisis is now being fought along sectarian lines, greatly diminishing religious freedom in the country. President Bashar al-Assad’s forces, aligned with Hezbollah and Shabiha, have targeted Syria’s majority-Sunni Muslim population with religiously-divisive rhetoric and attacks. Extremist groups on the other side, including al-Qaeda and the Islamic State of Iraq and the Levant (ISIL), have targeted Christians and Alawites in their fight for an Islamic state devoid of religious tolerance or diversity. Many Syrians choose their allegiances based on their families’ faith in order to survive. It’s important to note that all human rights, not just religious freedom, are suffering in Syria and in neighboring refugee camps. In quieter times, proselytizing, conversion from Islam and some interfaith marriages are restricted, and all religious groups must officially register with the government.

Rommy Mom is Nigeria’s David fighting the Goliath of a dysfunctional government. Mom, president of Lawyers Alert leads the campaign for human rights in Benue despite severe intimidation and threats for his life. Mom has not allowed circumstance to stagnate his vision for vocal and expressive liberation. In an interview with Index, the Index Awards nominee talked about his work in Nigeria and what motivates him to keep battling censorship inn his home country.
In mid-2012, floods led to casualties and loss of homes and livelihoods across Nigeria, with the Benue State one of the worst hit. Though some 500 million Nigerian naira of federal money were allegedly allocated to the people of Benue, the victims did not receive it. This prompted Mom to make use of Freedom of Information legislation to take Benue State Emergency Agency, the authority in charge of disbursing funds, to court.
He was subsequently attacked on a radio show by state governor Gabriel Torwua Suswam, and received phone calls from people close to the governor advising him to leave Benue or risk his life. According to local NGO Media Rights Agenda (MRA), “Benue state has a politically tense environment, so such a statement from a leader is an invitation for an attack on Rommy Mom.” The threats have gone uninvestigated, making it too risky for him to return home.
“Since the threat to my life, I have been forced to carry out my work from outside of Benue. This has not been easy, but it is part of the sacrifices and challenges of making accountability and transparency a currency in governance. The Freedom of Information Act is a critical starting point”, said Mom.
Mom has been nominated in the advocacy category for the Index Freedom of Expression Awards.
